민간경비규제 한ㆍ영 비교연구

국문 초록

경비업이 제도화된 지 30년이 지난 현재 한국의 민간경비제도를 되돌아보고 외국의 제도를 타산지석(他山之石)으로 삼아 한국실정에 맞는 제도를 만들어야 할 것이다. 영국과의 비교ㆍ검토를 통하여 다음과 같은 정책적 제안을 하고자 한다. 첫째로, 현재의 일반(특수) 경비원 신임교육이수증을 자격증으로 대체하여 부여하는 방안을 모색해 볼 수 있다. 신임교육을 이수한 경우 일정한 신청비용을 납부하도록 하여 교육을 이수하고 전과조회, 정신병경력 등을 검토하여 카드형태의 민간경비자격증을 발부하는 것을 검토해야 한다고 생각된다. 이는 민간경비종사자들에게 자부심을 심어주어 사기를 진작시킬 수 있다. 또한 신청수수료를 자격증발급자로부터 징수하여 영국과 같이 민간경비청(SIA)과 같은 별도의 기관을 설립하여 민간경비를 체계적으로 관리할 수도 있을 것이다. 둘째로, 민간경비분야에 따라 자격요건과 교육내용을 차별화해야 할 것으로 판단된다. 신임교육과정을 동일한 내용으로 하기 보다는 시설경비, 호송경비, 신변보호, 기계경비에 따라 교육내용을 그 분야에 맞는 것으로 개선해야 할 것이다. 셋째로, 민간경비회사 인증제도를 도입할 것을 제안한다. 한국의 민간경비업체 수가 2,671개로 그 민간경비회사의 수준은 일반 국민들은 알기가 어렵다. 대학에서 공학인증제, 대학공시제가 시행되고 있듯이 자율적으로 인증을 받도록 유도하는 방법도 고려해 보아야 한다. 넷째로, 경비원의 과거경력을 철저히 검토할 필요가 있다. 범죄경력의 기간경과에 대한 것을 세분화하여 범죄성향이 없어진 경우 경비원으로 근무할 수 있도록 하고, 정신병원 유치경력도 고려하여 경비원 자격을 부여해야 한다.

영문 초록

According to the SIA's 2003 strategic analysis, the annual revenue of the UK's private security industry is between £3 billion to £4 billion, and there are around half a million security operatives working within the industry. This compares to approximately 136,000 police officers. The Private Security Act 2001 calls for a range of measures to achieve its overall aims. But, perhaps, its most important contribution is that it provides sound foundations for introducing fundamental change. There is a unique opportunity to create an industry that is healthier, more successful and one that is respected. The SIA is committed to industry transformation for both buyers and purchasers, and to spread best practice right across the industry. There are Manned Guarding(Cash and Valuables in Transit, Close Protection, Door Supervision, Public Space Surveillance CCTV, Security Guard), Vehicle Immobilisation (immobilisation, restriction and removal of vehicles), and Key Holding by specialized manners in UK's private security licence. The fee for processing a licence application is currently £245 for all applications including renewals. Licence fees contribute to administration in processing and issuing licences, performing criminality checks, providing SIA staff and maintaining our office infrastructure, Research and development, etc. Suggestion of this study is as follows. First, Security authorities of korea should introduce specialized licences by classifying Cash and Valuables in Transit, Close Protection, Door Supervision, Public Space Surveillance CCTV, Security Guard. Second, It is important that everyone working in the private security has the right skills and knowledge to do their job well and safely. Contents of training course should be divided according to subjects of security sectors(Cash and Valuables in Transit, Close Protection, Door Supervision, Public Space Surveillance CCTV, Security Guard). Third, Korea should introduce Approved Contractor Scheme by assessing set of operational and performance standards for suppliers of private security services. Those organizations that meet these standards are awarded Approved Contractor status. Forth, those private security Authorities should consider relevant to licensing is carefully to assess the seriousness of criminality. A history of an offence or offences of dishonesty are considered to be relevant in relation to the role of a security operative since the role frequently involves the exercise of checks and searches. Likewise Authorities will take into account any recent mental health problems that be detained or been subject to other compulsory measures in the five years.
