경찰의 주취자 보호ㆍ관리 실태와 개선방안

국문 초록

주취자는 술에 취한 음주자로서 특히 알코올의 영향에 의해서 사회통념상 정상적인 판단이 어려울 정도로 취한 상태를 말한다. 또한 주취자는 무질서와 범죄를 야기하기 때문에 경찰에 의한 관리ㆍ통제의 대상인 동시에 보건의료 차원에서 국가가 주취자의 안전과 건강을 보호해야 하는 객체이다. 그러나 우리나라는 주취자의 관리 및 보호업무를 대부분 경찰이 전담함으로써 일선경찰은 업무과중에 따른 사기저하와 스트레스에 시달리고 있는 상황이다. 더욱이 공공장소에서 소란을 피우는 비응급ㆍ단순 주취자를 제지하고 보호할 법ㆍ제도적 장치가 미흡하여 이들 주취자의 인권침해와 신체적 위험이 자주 발생하고 있는바, 이에 대한 종합적인 개선방안 마련이 시급하다. 따라서 이 연구에서는 주취자에 대한 보호ㆍ관리 실태와 문제점을 면밀히 조사하였으며, 이를 토대로 우리나라 실정에 적합한 법ㆍ제도적 개선방안을 다음과 같이 제시하였다. 첫째, 경찰의 주취자 관리업무의 일관성과 통일성 확보를 위해 관련 매뉴얼의 전면수정이 필요하다. 또한 2010년 12월 1일자로 운영이 전면 중단된'주취자안정실'은 지금까지 제기된 문제점을 개선하여 재운영해야 한다. 아울러 경찰청 내부에'주취자 전담부서'를 설치하고, 주취자에 대한 경찰의 대응능력 향상과 인권의식 고취 및 정신건강 향상을 위한 프로그램이 마련되어야 한다. 둘째, 주취자를 효율적이면서 친인권적으로 관리ㆍ보호할 수 있는 관련 법령의 정비가 필요하다. 현재 국회에 계류 중인「경찰관직무집행법일부개정법률안(대안)」의 입법적 보완과 현행「경범죄처벌법」상의 구류제도의 적극적 활용이 요구된다. 또한 경찰청 훈령인「주취자안정실 운영규칙」의 법적근거를 강화해야 한다. 셋째, 경찰, 지자체, 소방공무원, 보건의료기관, 시민단체 등이 협력하여 주취자를 보호ㆍ관리하는 시스템 구축이 필요하다. 이를 위해 보건복지부가 추진하는 '음주폐해예방사업'과'알코올상담센터운영'에 경찰청의 적극적인 협조와 개입이 필요하며, 부산지방경찰청이 성공적으로 운영하고 있는'상습 주취소란자 치료ㆍ보호 프로그램'의 문제점을 보완하여 전국적으로 확대 시행할 필요가 있다. 끝으로 주취자의 인권을 보호하고 안전을 책임지겠다는 경찰의 투철한 사명감과 제도개선 의지 및 노력이 요구된다.

영문 초록

People are considered to be the intoxicated when they are drunken enough to be difficult to judge or control their behavior by the influence of alcohol. Also causing the social disorder and crime, the intoxicated have to be under control by the police administration while being protected their health and safety spontaneously from the health care resources of the country. However, in Korea, only the police take full charge of managing the intoxicated and it results in exceeding duties which make frontline police suffer from low morale and stress situation. Moreover, given that lack oflaw or institutional arrangements to deter a petit and non-emergent disturbance in the public places by the intoxicated trigger the frequent human rights violations and physical harm, system improvement for the intoxicated is urgently needed. In this study, status and issues of protection and management for the intoxicated people are closely researched, based on this situation, appropriate law and proper institutional measures for our country are proposed as follows. First, It is essential to correct the police manual comprehensively in order to ensure consistency and uniformity of police work relating the intoxicated. In addition to, the intoxicated care center which stopped on Dec. 1st in 2010 should be operated again after figuring out the problems. A designated office specializing for the intoxicated should be founded in the police department to provide encouraging programs which can train the responsiveness of the police toward the intoxicated and inspire human rights awareness and mental health. Second, relevant laws and regulations need to repair for better management of the intoxicated in the way of efficiency and humiliation. Currently pending in congress, alternative legislative bill on police enforcement is required to complement while the current system of detention in the Punishment of Minor Offenses is necessary to be adapted actively. In addition to, the legal basis of Police regulations and safety rules on the intoxicated care room should be strengthened. Third, the police, local authorities, fire officers, health care agencies, civic groups and those working to protect and manage the intoxicated are necessary to construct a network system which connect one another cooperations. As a good model, The Busan Metropolitan Police Agency's successful program for the chronic intoxicated should be expanded nationally. Finally, the police's strong sense of mission for protection and safety of the intoxicated people and dedication to improve the system is required.
