한국의 해외진출기업 위협요인에 대한 검토

국문 초록

한국기업들은 동서냉전체제가 붕괴된 1989년을 기점으로 해외에 활발히 진출하고 있다. 그러나 기업이 진출한 해외의 현실은 국가뿐만 아니라 개인, 국가 내의 다양한 이익집단, 다국적 기업, 국제조직 등과 같은 비국가행위자들(non-state actors)에 의해 주도되고 있으며, 국제사회도 다양한 국제기구, 국제적 비정부기구, 테러조직, 범죄조직 등의 비국가적행위자들이 군사력에 기초한 무력과 폭력을 행사하고 있기 때문에 다양한 안보위협요인에 직면해 있다. 해외진출기업의 위협요인 중에서 모든 요인을 포괄하는 것은 무의미할 뿐 만 아니라 안보 정책에 혼란을 가중할 수 있기 때문에 분류기준을 첫째, 해외진출기업의 유형의 재산뿐만 아니라 무형의 재산인 지적재산권에 대한 피해 둘째, 국가기관에 의한 공식적이고 객관적이고 표준화된 실태가 있는 피해 셋째, 보호법익과 관할권 등을 분류기준으로 하였다. 이를 통하여 테러리즘, 산업스파이, 해적행위가 해외진출기업 위협요인으로 논의되었다. 해외진출기업의 위협요인으로 분류된 테러리즘ㆍ산업스파이ㆍ해적행위를 실질적으로 분석한 결과, 그 위협 수위가 상당히 높은 것으로 나타났다. 이에 크게 국가의 역할과 기업의 역할로 구분하여 정책적 제언을 하였다. 첫째, 국가는 원칙적으로 기업의 영리목적 활동에 개입할 수 없다는 것이 학자들의 공통된 견해이지만, 해외에 진출한 기업의 근로자, 선원, 그리고 유ㆍ무형의 재산 등을 포괄적 안보개념에 입각하여 국가 안보영역으로 포괄하여 보호해 주어야 한다는 논지를 중심으로 논의하였다. 둘째, 해외에 진출하는 기업은 테러리즘, 산업스파이, 해적행위와 같은 위협이 있기 때문에, 해외에 진출하고자 하는 기업은 진출하는 해당국가와 관련된 자료를 충분히 검토하여야 하고, 또한 다양한 위기관리 매뉴얼의 개발 등을 논의하여야 할 것이다.

영문 초록

Korean companies have actively expanded to overseas making 1989 a starting point, when East-West Cold War system was destroyed. However the international market that the companies land is being driven not only by the states but also by the non-state actors such as individuals, various interest groups and multinational corporations. International society itself faces various security threats as non-state actors such as various International Organizations, International Non-Governmental Organizations, Terrorist Organizations, Organized Criminal Organizations are using force and violence based on their military strength. As to identify all the factors threatening the companies expanding their ways to overseas and incorporate them is not only meaningless but also giving confusions to the security policy, they were classified according to some criteria. The classification criteria were as follows; first, direct and indirect damage to the lives and properties of the companies in overseas, second damages to intangible assets such as Intellectual Property Rights (IPR) as well as the tangible assets, third, official, objective and substantial damages with the standardized cases by national authorities, fourth, protection of the law and jurisdiction. Through these, Terrorism, Industrial Espionage, and Piracy were discussed as the factors threatening companies expanding their ways to overseas. When analyzing substantial damages by Terrorism, Industrial Espionage, and Piracy, it was found that the threatening level was very high. Accordingly, a policy was proposed distinguishing the role of the state and that of the companies. First, it was asserted that the nation should protect the companies expanding their ways to overseas and their employees, ships sailing under the flag of Korea and sea men who sail on the sea for national interest, and the intangible assets of the companies such as Intellectual Property Right based on the concept of comprehensive security, although it is the common opinion of scholars that in principle states should not intervene the corporate activities for profit. Second, companies can enter various industrial fields to make profit. However, they can be directly exposed to the risks such as terrorism, industrial espionage and piracy with the advancement to overseas. Therefore, the companies that wat to advance to overseas should analyze and discuss the risk factors sufficiently and then make decisions after considering various facts related to the countries that they want to enter. Additionally, they should develop various kinds of Crisis Management Manuals and be equipped with the sense of security.
