특별사법경찰의 교육훈련 효율성 제고 방안에 관한 연구

국문 초록

범죄수사를 담당하는 사법경찰관리는 일반사법경찰과 특별사법경찰로 나뉘어진다. 일반사법경찰관리는 원칙적으로 사항적 또는 지역적으로 제한을 받지 않고 수사 권한을 행사하는데 반해, 특별사법경찰관리는 사항적 또는 지역적으로 한정된 경우에 수사를 진행한다. 이 논문에서는 특별사법경찰의 교육훈련 실태를 살펴보고 이에 대한 개선점을 제시하고자 하는 것을 목적으로 삼는다. 보통 일반사법경찰은 수사분야에 전문성이 있다고 인정되는 반면, 특별사법경찰은 담당하고 있는 업무분야에 전문성이 있다고 인정된다. 특별사법경찰은 장기적이고 지속적인 교육훈련이 필요하지만 실제 교육훈련의 여건은 자체 인력이나 시설의 부족으로 인하여 충분한 교육훈련이 이루어지지 못하고 있는 현실이다. 특별사법경찰의 교육훈련에 있어서 수사 전문지식의 함양이 요구되고, 교육훈련 시간이 절대적으로 부족하며 교육훈련을 담당할 수 있는 교육기관의 부족 등을 문제점으로 제시하였고, 이에 따라 수사전문 지식 함양을 위한 프로그램의 개발, 교육훈련의 확대, 특별사법경찰에 대한 교육기관을 지정하는 것 등을 개선점으로 제시하였다.

영문 초록

Generally judicial police of taking charge of criminal investigation is divided general judicial police and special judicial police. As a general rule general judicial police act authority without restriction of a matter and an area, but special judicial police exercise their right within the limit of a matter and an area. The purpose of this paper is that searching the actual conditions and indicating improve plans of education and discipline for special judicial police. Usually it is admitted that general judicial police have professional characters of criminal investigation and special judicial police have expert natures of their duties in charge. Special judicial police is needed education and discipline for long range and durability but actually it is lacked of education and discipline because of insufficiency of manpower or establishment. In education and discipline of special judicial police are demanded that the fostering of professional knowledge of criminal investigation and the shortage of education and discipline time and lack of educational facilities for special judicial police. In accordance with improvement plans is presented program development of the fostering of expert knowledge of criminal investigation and enlargement of education and discipline and appointment of educational facilities for special judicial police. The police agency for the education of crime investigation can help special judicial police with satisfactory educational facilities and educative environment, this scheme will be a rational proposal.
