조선시대 첩에 대한 포섭과 배제의 장치들

국문 초록

이 글은 『大明律』을 중심으로 조선시대 법조항 속에서 '처첩', '처', '첩'이 구분되어 쓰인 양상을 분류하여, 조선 국가의 공식적인 규정 속에 처/첩의 위계가 만들어지고 배치된 방식을 알아 본 것이다. 그 가운데 특히 구타, 간통 등 각종 범죄 및 범죄자에 대한 처벌 등에 대한 규정을 중심으로 살펴보았다. '처첩'으로 묶어서 논의된 조항은 국가와 남편과의 관계에 대한 경우, 처첩에 대한 남편에 대한 절대적 권위와 소유권에 관계된 경우, 남편의 부모 등 존장과의 관계에 대한 경우 등이 있다. '처'와 '첩'이 구분되어 표현된 경우는 일상적 관계 속에서 이루어지는 남편의 구타, 남편의 친인척과 처첩의 관계, 처첩의 자녀를 둘러싼 관계, 처의 권한을 보호하는 문제 등과 관련한 사항에 대한 것이었다. 이 때, 첩에 대한 처벌은 처에 비해 '1등급'에서 '3등급'까지 가중 또는 경감되었다. 그러한 등급은 처/첩과 갈등이 빚어진 상대가 누구인가에 따라 세밀한 차이를 보였다. '첩'이라는 존재는 조선의 가족관계 속에 완전히 포섭되지도 못하고, 완전히 배제될 수도 없는 모호한 위치에 놓여 있었다. 이러한 첩에 대한 규제를 통해, 가의 구성원과 그들 사이의 신분관계에 대한 위계는 세세하게 설정되었다. 첩은 단순하게 차별대우를 받은 것이 아니라, 조선시대의 가족과 신분의 위계를 설정하고 확고하게 만들고 작동시키는 하나의 '매개'였다.

영문 초록

This paper, focusing on Code of the Great Ming, examines how the ranks of wife/concubine were constructed within the formal regulation of Choson by classifying the ways in which "wife/concubine," "wife," and "concubine" were used separately in legal provisions. Especially, it focuses on the provisions regarding crimes such as beating and adultery, and the punishment of the related criminals. The provisions that discuss wife and concubine together are about cases of their relationships of the husband to the nation, of the husbands' absolute authority and ownership over these women, and of their relationship to the venerable elders such as the husband's parents. The provisions that discuss wife and concubine separately are about the cases of the husband's beating, of these women's relationship to the husband's relatives, of their relationship to their children, and of protecting the wife's rights. In those cases, the punishment of the concubines were aggravated or reduced in a range of "grade 1" to "grade 3" compared to the wife. These grades showed the differences in who were in conflict with the wife/concubine. Provisions on concubine were equipped elaborately and in detail throughout the matters of the husband's social position, the social position of wife/concubine, the status of concubine and her position within the family, the concubine's right to succession of property, ancestor worship ceremony, adoption, and penal code. The existence of concubine had an ambiguous position within the family relations of Choson as it was neither fully included nor fully excluded. Through the regulations on concubine, the hierarchy of family members was minutely established. Concubines were not under simple discrimination, they became a "medium" through which family and social hierarchy in Choson were firmly established and operated.
