국문 초록

조선전기사회는 고려사회가 가지고 있던 제도나 관습들에 대한 전면적 시정이 요구되었던 시기였다. 건국초 건국이념 및 그 기초를 주자학을 바탕으로 하여 형성된 이론을 가지고 국가의 질서를 구축하고자 하였던 대다수의 집권층은 자신들의 명분을 위하여 종법적 사상하에서 남성중심적 제도를 정립하고자 하였다. 하지만 어느 사회에서든지 하루아침에 기존의 관습이나 풍조가 바뀌는 것은 아니며, 특히 법제도에 영향을 미칠만한 사회제도 등을 더욱 오랜 시간을 두고 변경되어야만 한다. 이는 대다수의 사람들의 인식의 변경이라는 엄청난 변화가 요구되기 때문이다. 따라서 조선이 건국하면서 종법적 이론하에 건설하고자 하는 제도들 즉 여성의 지위를 폄하시킬 수밖에 없는 결과를 가져왔던 제도들 역시 조선 전기를 지나서 17세기 이후에야 어느 정도 자리매김을 하게 되었다. 그 결과 조선전기사회에 있어서 여성의 법적 지위는 후기에 비해서 상당히 평등적 관계에 있었다 할 수 있으며, 이는 혼속의 영향과 재산상속의 관습 등을 통해서 확인할 수 있는 것이다. 다만 이러한 가운데 종법의 영향으로 가부장적 가족제도의 강화와 여성의 순결 내지는 순종의 강요로 인하여 조선 후기와 구한말 일제강점기를 거치면서 여성의 지위는 더욱 불평등한 지위로 변질되었다. 따라서 남녀종속적 관계가 아직 확고히 자리 잡기 전인 조선 전기 사회에서의 여성의 법적 지위를 통해 당시 여성이 가졌던 사회적 위상에 대해 살펴보는 것은 조선 후기의 변질된 여성상에 비해 상당한 의미를 부여한다.

영문 초록

Generally speaking, the Joseon Dynasty is the society blood relation in the male line. It is think that Women has treat inferior of Men. Because at establishment of Joseon Dynasty, it be influenced by a code of clan regulations of China. That is to say, the formality of Religious ceremonies and Marriage ceremonies have been changed androcentric system. Also the late Joseon society was the strict patriarchal male line society. In period of japanese imperialism occupation by force, our tradition is distorted. Since then at this point in time the Civil Law enact, rational traditional Law System cannot be reflected. Nevertheless the early Joseon introduced into a code of clan regulation of China, Marriage Customs was continue a matrilocal System. Specially on System of Inheritance Law, if not will, it was continued the inheritance by equal distribution. Therefore legal position of women maintain Goryeo period Women's position. That is to say it is the same Son that a Daughter become a successor. And Widow was recognized spouse's position at Inheritance. In the True Record of the Joseon Dynasty, the expelled Divorce be made use of a means for maintain to the family relations in patriarchal system and the arbitrary country rule. This Divorce system widely different with today system. And it is a conclusive factor to abridge on the women's position in Joseon society. For maintain of the patriarchal system, Women have been restricted on the system of public law.
