현대판 노예로 살아가는 장애인의 인권에 대한 소고

국문 초록

본 연구는 최근 한국 사회에서 문제시 되고 있는 현대판 노예로 살아가는 장애인의 인권에 대해 언급하였다. 장애인이 인간다운 삶을 살기 위해서는 장애인 당사자의 권리에 대한 인식과 자각이 필요하다. 이것은 당사자뿐만 아니라 모든 사람에게 해당되는 부분이다. 장애인의 인권과 복지에 대한 사회복지적ㆍ법적 제도화는 되었지만 정작 장애인과 더불어 살아가고 있는 비장애인의 인권 감수성이 낮다. 언론을 통해 비춰진 현대판 노예로 살아간 사람은 자유의지 없이 인간다운 삶을 살아보지 못하고 지역사회 주민들의 무관심 속에 살아왔다. 따라서 본 연구는 장애인 인권에 대한 낮은 현실을 지각하면서 장애인 인권의 개념과 발달과정, 장애인 인권에 관한 주요 이슈, 한국 현대판 노예의 중심이 되어버린 장애인 인권의 현실, 장애인의 인권 신장을 위한 제언 순으로 기술하였다. 결론적으로 현대판 노예로 전락되어버린 장애인의 인권을 신장하기 위한 방안을 제시하면 다음과 같다. 첫째, 장애인 당사자의 인권 침해 자각 능력이 향상될 수 있도록 교육 및 역량강화 프로그램이 개발되어야 한다. 둘째, 현대판 노예로 살아가는 장애인이 없도록 노동을 중심으로 한 민ㆍ관 관계기관의 지역별, 장애유형별 인권침해 실태조사를 실시하여 그에 따른 다각적인 대책 마련이 강구되어야 한다. 셋째, 가정, 학교, 직장, 지역사회에서의 차별, 폭력 등의 인권침해에 대한 조사뿐 아니라 인권감수성을 높이기 위한 단계적인 인권교육이 진행될 수 있도록 해야 한다. 넷째, 장애인 인권 증진을 위한 국가 및 민간단체의 협력증진과 관련 단체의 기능강화를 위한 법적인 지원, 전문가 양성을 위한 프로그램 개발이 필요하다.

영문 초록

This study considers the human rights of disabled people who live as a modern slavery, which has risen as a social problem in South Korea. For a disabled person to live like a human being, he needs awareness and recognition of his own rights. This goes for all the people as well as the disabled. In spite of institutionalization of social welfare and legal aspects for human rights and welfare of the disabled, the human rights sensitivity of the non-disabled who live together is low. The disabled person who lived as a modern slavery shown by the media had no free will of his own and couldn't live his life as a human being neglected in the indifference of resident of community. Therefore, with the recognition of reality of human rights of the disabled, this study accordingly describes in order the concept and development of human rights of the disabled, main issues on the human rights of the disabled, the reality centered around a modern slavery of the human rights of the disabled people, and suggestions to promote the human rights of the disabled. In conclusion, suggestions to promote the human rights of the disabled that have degenerated as a modern slavery are as follows. Firstly, education and empowerment program to improve the self-awareness of human rights violation for the disabled person should be developed. Secondly, an actual condition survey focused on labor initiated by public and private of related institutions should be performed to ensure that no disabled person live like a modern slavery, and various measures should be provided. Thirdly, survey on human rights violation such as discrimination and violation at home, school, work, and community should be conducted and phased education to improve human rights sensitivity should be performed. Lastly, promotion of public and private institution's cooperation to promote the human rights of the disabled, legal support to enhance the related institutions' function, and program development for expert training are needed.
