한국 ADR법제의 개선을 통한 협상능력 제고방안

국문 초록

본 연구의 목적은 한국 ADR법제의 개선을 통해 상사분쟁의 협상능력을 제고하기 위한 방안을 모색하는데 있다. 본 연구를 위해 법제 연구와 실태적 연구를 병행하였다. 법제 연구로는 UNCITRAL 및 주요 국가의 ADR법제를 비교분석하고 한국의 중재법, 대외무역법 및 한국 유일의 상사중재기관인 대한상사중재원(KCAB)의 중재규칙상의 ADR관련 규정을 분석하였다. 그리고 본 연구는 KCAB의 알선, 조정 및 중재절차를 통하여 협상과의 연관을 위한 절차 및 합의율에 관한 실태를 분석하였다. 연구결과에 따르면, UNCITRAL 모델조정법 미국과 일본의 ADR 이용촉진에 관한 법제를 원용하여 ADR 기본법을 제정해야 하고, 대외무역법상의 알선에 관한 규정을 대한상사중재 원장에게 위탁한 것을 고려하여 시행령상의 절차 규칙을 대폭 개정하여야 할 것이다. 그리고 중재절차상의 화해판정을 위한 중재인의 화해주선에 관한 규정을 중재법 개정 시에 신설할 필요가 있으며, 기업체와 국민들의 협상에 관한 인식을 제고시키고 협상전문가를 육성하여 ADR제도와 협상에 관한 저변을 확대하고 확산시켜야 할 것이다. 결론적으로 한국에서 상사분쟁의 협상능력을 제고하기 위해서는 한국 ADR 제도의 법제를 개선하고 협상전문가를 육성해야 할 것이다.

영문 초록

Purpose : The purpose of the paper is to suggest the way to enhance negotiation of commercial dispute by improving commercial ADR legislation in Korea. Research, design, data, methodology : this paper analyzed the present situation and problems of Korean commercial ADR legislation based on law and practice of international ADR and negotiation and examined ADR legal legislation of UNCITRAL, USA, Japan and other countries. In the paper especially through the analysis of actual condition of success rates of mediation, conciliation and arbitral award on agreed terms of KCAB have been analyzed. Results : According to the said research, Korean ADR legislation should be enacted by incorporating the necessary contents of UNCITRAL Model Law on Conciliation, ADR legislation and practice of US, Japan and other countries. Relevant mediation articles specified in the Korean foreign trade act revised to entrust the power to KCAB. Korean Arbitration Law should be revised that an arbitral award on agreed terms can be recommended by arbitrator(s). And understanding of commercial negotiation & ADR and professionalism of negotiator should be strengthened to diffuse commercial negotiation and ADR in Korea Conclusions : This paper provides for ways to enhance commercial negotiation through improvement of Korean commercial ADR legislation.
