미국 낙태법상 인지된 동의에 관한 고찰

국문 초록

미국의 경우 많은 주에서 의료진에게 낙태를 하려는 여성에게 일정한 정보를 공개하도록 하고 있고 이에 기초하여 여성이 인지된 동의를 할 것을 요구하는 법률을 제정하여 왔다. 하지만 충분한 정보를 제공하고 여성의 알권리를 보장한다는 긍정적 취지를 가짐에도 불구하고, 현재 미국 각 주에서 제정되고 있는 낙태법상의 인지된 동의에 대해서는 제공되는 정보가 정확한 것인지, 여성의 결정에 실제적으로 도움이 되는 지에 대해 비판이 제기되어 왔다. 또한 낙태에 대하여 중립적이지 않으며 편견을 가진 정보를 고지하도록 요구하고 있다는 점 역시 문제되고 있다. 이에 본 논문에서는 주의 인지된 낙태동의법의 제정배경과 주요 내용 및 타당성을 검토하고자 한다. 먼저 인지된 낙태동의법에 대한 연방대법원의 중요한 판결을 살펴봄으로써 여성의 낙태에 대한 결정권을 제한하는 인지된 낙태동의법의 위헌성 여부를 판단한다. 또한 각 주의 인지된 낙태 동의법의 중요 내용과 이에 대한 비판의 타당성을 검토한다. 결론적으로 낙태절차의 본질에 관하여 정확한 관련정보를 제공해주고 이를 기초로 여성이 합리적 판단을 내릴 수 있도록 하는 것은 낙태절차가 갖는 의학적 절차로서의 특질을 고려할 때 타당하다. 그러나 주 낙태법에서 요구되는 낙태위험에 관한 불확실한 정보제공, 태아발전상태에 대한 구체적 설명과 사진, 강제적인 초음파검사 등은 여성의 자율적인 판단을 존중하기보다는 여성의 결정과정에 위헌적으로 개입하는 것일 수 있다. 그리고 Casey 판결에 의하여, 진실되고 오해를 불러일으키지 않는 정보를 제공하는 인지된 동의법의 경우에는 헌법상 허용될 수 있지만, 다수 주의 인지된 낙태법은 이러한 헌법상 한계를 벗어나고 있다는 점에서 문제가 있다.

영문 초록

The United States has enacted laws in the federal and state level that require informed consent to women based on disclosed information by physicians. Despite its positive intention of supplying sufficient information and securing the right-to-know, there has been a criticism if the information on the abortion informed consent law is correct or if such information is actually of help to the decision of the woman. And, there is additional problem that it is not neutral to abortion but requires biased information. Thus, this study would like to review the background of enactment, main contents and validity of the informed consent of the abortion law. Firstly, this study examined the important decisions of the United States Supreme Court on the abortion informed consent in order to examine the violation of the constitution of the abortion informed consent law. And, this study also reviewed the main contents of the abortion informed consent law by states and the validity of criticism. In conclusion, it is valid to provide information on the nature of abortion procedure so that a woman may make a reasonable decision considering the features of medical procedure of the abortion. However, uncertain information on the risk of abortion required by the abortion law of the state, specific description of the fetal development, mandatory ultrasound on the fetal might be regarded as the violation of the constitution as they do not respect autonomous decision of women. While the informed consent of the abortion law that provides authentic and clear information might be allowed by the ruling of Casey, it is problematic in that the requirements of consents in many states exceed such constitutional limit.
