개별 기본권의 개정방향

국문 초록

국가의 목적은 개인의 자유와 권리를 확보하고 이를 보장하는 것이라는 것은 오늘날 일반적인 인식에 속한다. 그러나 헌법이 개인의 자유와 권리만을 보장하기 위해 존재하는 것은 아니다. 헌법은 개인의 자유와 권리를 보장하면서 동시에 국가안전보장 등 공익도 보호하려는 것을 목적으로 한다. 따라서 헌법은 개인의 자유와 권리 그리고 공익을 조화시키는 것을 목적으로 하고 있다고 할 수 있다. 20세기 중반에 탄생한 대한민국헌법은 개인의 자유와 권리를 어떤 의미에서는 망라적으로 보장하고 있다. 헌법 제10조에서 대전제로서 인간의 존엄과 가치 및 행복추구권을 규정하고 제11조로부터 제36조에 이르기까지 개별기본권들을 일일이 예시하고 제37조 제1항에서는 그 전까지 열거되지 아니한 자유와 권리라고 할지라도 열거된 것과 적어도 동일하게 보장받음을 선언하고 있다. 그 제한에 있어서는 법률로써만 가능하게 하고 제한하는 경우에도 본질적인 내용은 침해할 수 없게 함으로써 기본권보장에 완벽을 기하고 있다. 이러한 기본권체계 속에서 기본권보장의 틈은 있을 수 없다. 그럼에도 헌법개정의 경우에는 기본권개정도 논의될 것이 예견되고 또 기대되기도 한다. 그 이유는 우선은 현행 헌법은 개별기본권 간에 좀 더 체계적인 구성이 필요하다는 점과 이제 시행 60년을 훨씬 넘은 시대상황에 따른 반영이 필요하기 때문이다. 여기다 한 가지 더 첨언하자면 그 동안 헌법재판소의 판결을 통해 확고하게 자리 잡은 헌법적 가치들을 성문화할 필요성이다. 현행 헌법상의 기본권보장의 완결성을 고려하면 기본권개정은 소폭에 그칠 것으로 예견할 수 있지만, 새로운 상황의 변화에 대응하는 것과 함께 그 동안 우리 헌법사가 이루어낸 적지 않은 기본권이론의 성과들이 충실히 반영될 수 있기를 기대하면서, 이 글은 개별기본권을 11개의 범주로 나누어 그 동안 제시된 주요 안들을 소개하고 그에 대해 필자의 의견과 개정방향을 제시하고 있다. 이 연구는 이전의 기본권총론 개정안에 대한 후속적 연구로 이루어졌다. 다음으로 필자에게 남은 과제는 이제 기본권개정안을 마련하는 일이다.

영문 초록

Belongs to the common perception today that the nation's objective is to secure and guarantee the rights and freedoms of the individual. However, the Constitution does not exist in order to ensure the rights and freedoms of the individual only. The Constitution guarantees the rights and freedoms of the individual, while at the same time also want to protect public purpose, for example, national security. Therefore the main aim of the Constitution is to harmonize the rights and freedoms of the individual and public interests. The Constitution of the Republic of Korea was born in the mid-20th century, covering all the rights and freedoms of the individual, in a sense, without exception. Article 10 as a Premise guarantees the dignity and worth of the human being and the pursuit of happiness, and the basic rights of the individual, ranging from Article 11 under Article 36, are ensured as examples for guaranteed rights and freedoms. Constitutional rights of the individual that are not enumerated from in the Article 10 until 36 are also declared in Article 37 paragraph 1, that they are at least equal to those listed at the level of protection. Those rights and freedoms should be limited only by law and their limitations should not infringe the essence of the basic rights and freedoms. We could not break these basic rights in this system of basic rights. Nevertheless, in the case of amendments to the Constitution, basic rights revisions to be discussed can be foreseen and expected. The reason is, first, the need for a more systematic configuration between the individual basic rights, and second, the reflection of the situation of the era into the current Constitution which is changed in the past over 60 years. One more side noted in here, the constitutional values firmly located during the ruling of the Constitutional Court should be codified. Considering the integrity of the current constitutional basic rights, predicted revisions of the basic rights will be limited to the narrow. Hoping the corresponding changes in the new situation along with the achievements of the Constitutional Court can be reflected faithfully in the chance of the Constitution, this article presented the main proposals introduced during the present direction of the revision and my opinion about them in the 11 categories. This study was done as a follow-up study for the previous General Study of my own. The challenge to me now is to create the basic rights amendments.
