건강보험료 부과체계의 합리적 방향에 대한 법정책적 소고

국문 초록

건강보험료 부과체계의 개편 논의는 지속되어 왔다. 특히 조합주의 방식으로 시작하였던 우리나라 건강보험이 통합이 되면서 보험료 부과체계를 어떻게 할 것인가는 당연히 중요한 이슈 중의 하나였다. 더구나 직장가입자와 지역가입자를 구분하면서도 통합하여 운영되는 건강보험 내에서 여전히 두 가입자 간의 보험료 부과체계가 달라 형평성 문제가 제기되고 있다. 이에 국민건강보험공단은 소득을 기준으로 하는 보험료 부과체계 논의를 펼치고 있다. 우리나라 현행 건강보험료가 경제적 능력에 따라 부과되는데 있어 형평한가, 또는 헌법상의 공과금 부과 원칙에 따라 법적 및 사실적으로 평등하게 부담하는가? 건강보험의 원리에 충실한 것인가? 이 논문은 국내 기존의 연구에서 부족한 부분을 보완하고자 법정책정 측면에서 우리나라 및 독일ㆍ프랑스의 보험료 부과체계를 상론한 후, 지역가입자에 대한 보험료 부과체계에 대한 시사점을 찾고자 한 것이다. 현행 지역가입자에 대하여 보험료 부담 능력을 적정하게 반영하지 못하여 자격변동에 따라 보험료에 현격한 차이가 발생하는 등 보험료 부과의 불형평성을 초래하고 국민의 법감정에 어긋나는 실정이다. 건강보험료 납부의무를 부과하는 건강보험료 부과에 관한 법은 ‘사실적 결과에 있어서도 부담의 평등’을 원칙적으로 보장할 수 있는 절차적 규범이나 제도적 조치와 결합되어 직장 가입자와 지역가입자 사이는 물론, 지역가입자 내에서도 균등부담을 보장해야 한다.

영문 초록

The discussion on reorganizing the system of imposing the National Health Insurance contribution has been continued. Especially, how to impose the health insurance contribution is the one of critical issues since the previous health insurance of Korea started with unionism became integrated. In addition, within the health insurance which differentiates the people if they have either employer-provided health insurance or with residence-based insurance and integrates to operate at the same time, the different system of imposing insurance contribution between the persons with employer-provided health insurance and with residence-based insurance raises a question on fairness. Therefore, National Health Insurance Corporation has discussed on the system of imposing the health insurance contribution based on income. Is the current health insurance contribution of Korean fair to impose the contribution based on the financial power? Does it bear fair contribution legally and realistically by following the principle of imposing utility bill under constitutional law? It is followed by the principle of health insurance? This study is to discuss the systems of imposing insurance contribution in Korea, Germany and France in the aspect of law strategy and then, to find the implication on the system of imposing health insurance contribution for locally insured person in order to supplement the lack of precedent studies in Korea. It causes unfairness of imposing health insurance contribution and is contrary to the national contribution lings of law since it didn’t properly reflect the ability to be responsible for paying insurance contribution for locally insured person and ended up making wide difference on insurance contribution due to qualification change. The law on imposing health insurance contribution with a duty to make the payment for health insurance contribution ‘must combine either with procedural standard or institutional measure which may guarantee the fairness for paying the contribution in principle even in the truthful result and assure equal payment within locally insured people as well as between employer-provided health insured person and locally insured person.
