소년형사사법제도의 실태 및 개선방안

국문 초록

성인범 못지않은 소년범죄로 인하여 소년범의 범죄율을 낮추고, 재범을 방지하기 위해 각종 제도들이 새롭게 등장하고 있고, 소년사법분야에서도 소년사법의 근간이 되는 「소년법」과「보호소년 등의 처우에 관한 법률」의 개정을 통해 비행소년 또는 범죄소년의 인권보장 및 재범방지를 위한 각종제도가 새롭게 도입하는 등 제도개혁을 꾀하고 있다. 그럼에도 불구하고, 형사사법기관에서의 처분내용은 소년범죄에 대한 예방을 하지 못하고 있는 실정이다. 따라서 기존의 획일적인 시스템에서 벗어나 소년범의 개선ㆍ교화에 유용하며 다양한 처분으로 첫째, 사법기관의 개입은 최소화하기 위해 다기관협력체제의 구축이 요망된다, 둘째, 경찰과 검찰은 '처벌'보다는 '선도'에 초점을 맞춘 '소년범 다이버전'제도를 더욱 확대 추진의 요청이다, 셋째, 기소 전 단계에서의 경찰에서 소년의 인격성과 환경조사의 실시요청이다. 넷째, 소년범 업무처리의 효율성을 더욱 높이기 위해서는 형사사법기관 들의 정보교류와 소년법원 설치 및 관련기관의 전문가 양성이 필수적이라고 할 수 있다.

영문 초록

Juvenile Delinquency can be defined as not only a punishable crime but also a deviant social behavior out of the principle which the adolescents are expected to do, even though it is not applicable to essential conditions for a crime. The problem in juvenile delinquency is that they don't have any feeling of guilt. There is an attempt as the newly introduced various schemes for the protection of human rights and the juvenile delinquent or criminal recidivism prevention through the revision of the Act on the process of institutional reforms on the judicial system of the juvenile delinquency. Unfortunately, Juvenile offenders for legislative improvements that are still weak and there are many problems despite of several rounds of revision Improvement. In foreign countries tend to reduce unnecessary judicial process which is related issues for juvenile delinquents on the behavioral problems of the juvenile delinquents to minimize the negative impact on youth. For this reason, useful and enlightening of a variety disposal from existing monolithic system improvements is to built the cooperative System in order to minimize of die intervention of law enforcement agencies with taking advantage of the intervention version. Second, it is requested that leading of the diversification list. Third, it is made a request of the whole of the boy's personality and environmental investigations in the prosecution from police. Finally, in order to further increase the efficiency, to exchange of informations, built the juvenile court and train the expert who is related agencies is essential.
