국문 초록

산업화⋅도시화⋅핵가족화로 동방예의지국의 의미도 경로효친의 사상도 점점 퇴색되어 가고 현실이며, 안정적인 수입원의 부재와 빈곤, 경제적 어려움, 일자리 취약성, 신체적, 정신적 건강의 취약성, 사회적 고립과 단절이 노인혐오와 차별을 겪게 만들었다. 특히 코로나 19로 인해 사회적 관계의 어려움은 더 커지고, 노인혐오와 차별은 각종 노인 대상 범죄로까지 이어지고 있으며 이러한 노인 인권의 침해 상황을 해결하고 노인인권을 보호하기 위해 다양한 정책들이 실행되고 있다. 특히 빠르게 변화하는 시대변화에 조화롭게 순응하고 권리주체로서 활동하기 위해서는 기초적으로 각종 정보 등에 접근성이 보장될 수 있도록 사회적인 체계들이 구축 운영되고 노인들이 이를 활용할 수 있는 역량을 갖출 수 있도록 지원하는 제도들 역시 구비되어야 함에도 불구하고 전 세계적으로 이러한 법제도적인 방안들의 모색에 대해서는 간과하고 있는 실정이며 노인인권의 취약성이 보다 심화되고 있는 상황이다. 이에 본고에서는 형사정책적 관점에서 다섯 가지의 정책으로 첫째,「노인 혐오금지법」제정, 둘째, 자치단체별 ‘노인인권보호’ 의 조례안 제정, 셋째, 범죄피해자 지원센터의 노인 교육프로그램 개발 및 활성화, 넷째, 자치단체별 ‘노인혐오 범죄 예방 및 인권보호’를 위한 협의회 구축, 다섯째, ‘혐오범죄 예방지도사’ 자격증 신설을 제안하였다.

영문 초록

Due to industrialization, urbanization, and nuclear familyization, the meaning of the Eastern country and the idea of the elderly filial piety are gradually fading, and the lack of a stable source of income, poverty, economic difficulties, job vulnerability, physical and mental health vulnerability, and social isolation and disconnection have caused elder hatred and discrimination. In particular, COVID-19 has increased the difficulty of social relations, elder hatred and discrimination have led to various crimes against the elderly, and various policies are being implemented to resolve the violation of the human rights of the elderly and protect the human rights of the elderly. In particular, in order to harmonize with the rapidly changing times and act as a rights subject, social systems must be established and operated to ensure access to various information, and systems that support the elderly to have the ability to utilize them must also be prepared, but the search for these legal and institutional measures around the world is being overlooked, and the vulnerability of elderly human rights is intensifying. Therefore, from a criminal policy perspective, this paper proposed five policies: first, the enactment of the “Act on the Prohibition of Elder Hate,” second, the enactment of the “Protection of Senior Human Rights” by local governments, third, the development and activation of education programs for the elderly at crime victim support centers, and fourth, the establishment of a council for “prevention and protection of human rights against elder hate crimes” by local governments, and fifth, the establishment of a “Hate Crime Prevention Instructor” certificate.
