국문 초록

최근 안보환경의 변화로 인해 온라인공간에서 이루어지는 테러리즘의 불법적인 정보제공은 유관기관의 기능에 대해 사전예방적이고 적극적인 역할을 기대하고 있다. 테러와 같은 범죄는 국경을 초월하고 있고, 범죄행위의 수단과 방법도 은밀하게 진행되고 있기 때문에 특정 국가의 유관기관이 단독으로 예방과 대응하는 데에는 한계가 있다. 이는 사전예방적 기능에 해당하는 테러정보 차단을 위한 감시나 모니터링 및 사후 진압을 위한 수사와 처벌에 있어서도 유관기관 간의 협조 또는 국제사회의 협력과 공조가 반드시 필요한 부분이다. 국내에서는 테러리즘과 관련된 선전⋅선동 행위를 제한하기 위해 테러방지법, 정보통신망법, 방송통신위원회법, 정보통신에 관한 심의 규정들이 시행되고 있으며, 해당 법규 위반시 불법정보에 대한 거부와 정지 그리고 제한을 두고 있는 실정이다. 그리고 유럽연합과 영국, 호주와 같은 국가에서는 테러범죄와 같이 국가안보나 국익을 침해하는 범죄에 대해서는 사전에 적극적으로 차단하는 정책은 시사하는 바가 있다.

영문 초록

Recently, illegal information about terrorism is being provided online due to change in the security environment. This phenomenon requires preventive and active functions and roles from related organizations. There are limits to the ability of relevant organizations in specific countries to prevent and respond independently because terrorist crimes transnational borders and the means and methods of criminal acts are carried out secretly. In particular, cooperation between relevant organizations and the international community are essential in surveillance and monitoring to prevent terrorism information, which are preventive functions, and investigation and punishment. In Korea, Act On Counter-terrorism For The Protection Of Citizens And Public Security, Act On Promotion Of Information And Communications Network Utilization And Information Protection, Act On The Establishment And Operation Of Korea Communications Commission, and the Deliberation Regulations on Information and Communications are being implemented in order to limit propaganda and incitement activities related to terrorism. In case of violation of the relevant laws, rejection, suspension, and restrictions on illegal information. Also, in countries such as the European Union, the United Kingdom, and Australia, the policy of proactively preventing crimes that violate national security or national interests has implications such as terrorist crimes.
