국문 초록

우리 사회에서는 자고나면 성범죄가 기사화되고 여성들과 특히 아동을 자식으로 둔 부모는 불안감에 시달리고 있는 실정이다. 최근 잇따른 패륜적 성폭력 사건으로 사회 불안이 가중되고 있다. 인면수심(人面獸心)의 입에 올리기조차 끔직하고 잔혹한 성범죄가 기승을 부리고 있다는 점에서 어쩌면 대한민국은 '성범죄 공화국'이라는 오명을 가지게 될 지도 모른다. 우리 사회의 성범죄에 대한 온정주의(溫情主義)와 사법부의 솜방망이 처벌이 성범죄를 조장한 면이 있다. 하루가 멀다고 발생하는 성범죄 사건을 예방하고, 특히 어린이나 장애인 등 사회적 약자를 대상으로 한 성범죄자에 대해서는 예외 없이 강력한 처벌을 해야 한다는 것이 국민들의 정서이다. 헌법상 포기할 수 없는 가치인 생명ㆍ신체ㆍ인격을 유린하는 범죄로부터 피해자를 보호해야 한다는 사회적 요구가 어느 때보다 강한 공감대를 형성해가고 있다. 사회를 충격에 휩싸이게 하는 범죄들이 발생하면서 상습성이 강한 범죄와 회복하기 어려운 피해를 야기하는 강력범죄에 대해서 적극적인 대응이 필요하다는 여론도 함께 형성되고 있다. 본고에서는 우리사회에서 성범죄가 발생할 때마다 등장하고 강력해진 성범죄 방지대책으로 운영되고 있는 전자감시제도일명 전자발지제도, 신상공개제도, 성충동약물치료, 치료감호제도의 내용과 운영상의 문제를 살펴보고, 경찰의 성범죄 전력자 관리를 검토하면서 성범죄 재범방지를 위한 경찰의 대응방안으로 위치추적전자장치 착용 성범죄자의 정보 공유, 다기관 공공보호 협의체(MAPPA) 벤치마킹 등을 논구하고 있다.
