국문 초록

지속가능한 발전과 환경보호는 오늘날 국제사회가 추구하는 핵심이다. 중국은 개혁개방이래 빠른 경제성장으로 인한 자원 고갈 및 환경문제 등으로 국내외적으로 성장한계의 압박을 받고 있다. 이러한 한계를 극복하고자 중국은 2000년대 후반부터 경제성장의 발판을 자유무역의 지역화에 두고 전 세계의 다양한 국가와 자유무역협정(FTA) 체결을 가속화 하고 있다. 중국은 FTA를 통해서 주변국과의 우호적이고 협력적인 관계를 구축하고, 지속가능한 발전을 위한 자원 확보, 제도 및 체제 정비 등의 사회·경제적인 이익을 도모하고자 한다. FTA를 통한 환경문제의 접근은 눈에 띠게 전개되고 있지는 않지만, 상대국에 따라 점진적으로 확대시켜나가고 있다. 중국이 기체결한 FTA 협정문 상의 환경관련 조문들을 살펴보면 전문에 포괄적이고 일반적인 환경보호에 관해 언급하거나, 상품·서비스무역제한 금지의 예외로서 환경보호를 포함하거나 또는 환경협력에 관한 규정을 포함하는 등의 형태로 나타난다. 중국은 환경문제에 대해 높은 수준으로 상대국에 대해 환경의무를 구체적으로 부과하기보다는 쌍방당사국이 환경문제를 해결하기 위하여 서로 협력하도록 하는 것에 초점이 맞춰져 있다. 한국과 중국은 지정학적으로 근접하여 역사적으로도 사회전반적인 부분에서 서로 영향을 받아왔다. 더욱이 중국의 빠른 경제성장으로 인한 국내환경 악화는 주변국인 한국에 직접적인 영향을 미치게 됨으로써 양국의 환경문제 해결을 위한 협력이 보다 절실히 요구되고 있다. 이러한 상황에서 한국과 중국은 FTA 협상이 진행되고 있고 이미 환경분야에 대한 전문가 협상이 진행되고 있는 가운데 중국 FTA 협상에서 어떻게 환경문제를 다루고 있는지 살펴보는 것은 중요한 시사점이 있을 것으로 본다.

영문 초록

Sustainable development and environment protection are the ultimate goal that the international society pursuits. Under the circumstance, China is under pressure to overcome the exhaustion of natural resources and environmental problem stemmed from rapid economic development. In order to overcome the limitation, China has put a foundation of economic development on the regionalization of free trade since the late of 2000, and has been accelerating the conclusion of FTAs with the various countries. Through FTAs, China is willing to forge favorable and cooperative relationships with neighboring countries, to secure the resources for sustainable development, and to improve social and economic institutions and structure. With respect to dealing with the environmental issue in FTA, however, it seems to be slow in progress, but getting to expand. Taking into account the articles of agreements in the FTA concluded, the environment related articles take the forms in the agreements like referring comprehensive and general declaration for environment protection in the Preamble, including the article for environment protection as a general exception for prohibiting the restriction of goods and services trade, or including the provision for environment cooperation, and so on. China’s strategy for the environmental issue is focused on the environment cooperation, rather than imposing heavy environmental liability on the country concerned. Korea and China are close geographically so they are influenced by each other historically and socially. Moreover, the environment deterioration in China caused by rapid economic development directly affects neighboring country, Korea, which makes the environment cooperation between two countries is urgently needed. Under the circumstance, Korea-China FTA is already in negotiation and the experts’ conference on environmental issues has been launched currently. At this present, to study how China deals with environmental issue in FTA negotiation would provide an important policy implication to Korea.
