국문 초록

종중은 법률상으로 대부분 법인격 없는 사단으로 존속하면서 오늘날 급격한 변화를 겪는 법인격 없는 단체의 하나이지만 우리 사회의 전통적 생활양식의 하나로서 그 영향력이 매우 큰 단체이며, 종중재산을 소유하고 있는 것이 보통이다. 종중재산은 현대적 등기제도가 도입된 이후 현재까지도 종중명의로 되어 있지 않고 종손이나 수인의 명의로 등기되어 있어, 이를 둘러싼 여러 문제들이 발생하고 있다. 대표적인 문제로써 부동산실명법상의 명의신탁 대상에서 제외되어 있다는 점과 농지법상의 농지취득이 제한된다는 점, 종중명의 재산의 처분이 용이하다는 점을 들수 있다. 따라서 이러한 문제점을 해결하고 종중재산을 효율적으로 관리하기 위해서는 종중재산의 명의신탁금지, 농지법의 개정 보완, 종중태산 처분요건의 강화 등의 방안이 제시될 수 있으며, 이러한 제도의 개선을 위한 일련의 조치로는 민법을 비롯한 관련 법률의 전면적인 재검토와 함께 법률개정을 통한 제도의 보완이 시급하다고 본다.

영문 초록

Clans are one of the institutions without legal personality that have been experiencing a drastic change these days, mostly existing as corporations without legal personality, but they are one of our traditional life styles as an entity having a great influence on our society, and they generally have their own properties. Clans` properties have been registered under the names of the eldest grandson of the head family or a few persons, not under the name of clans since the modern registration system was introduced, and so, a lot of problems are now occurring around this. Representative problems related to clans properties include that Clans` properties have been excluded from the objects of title registration under a third party`s name under the Act of Substantial Named Registration of Real Estate; that they have been confined in terms of their right to acquire farmlands under the Agricultural Land Act; and that it is easy to dispose the properties under the name of clans. Therefore, in order to solve these problems and manage clans` properties effectively, it is necessary to prohibit the title registration under a third party`s name of clans` properties; revise and supplement the Agricultural Land Act; and reinforce the requirements for disposing those clans` properties. Furthermore, a series of measures for improving this system include an overall review of related laws and regulations including the Civil Law, and I think that in addition to this, it is urgent to supplement this system through the revision of related laws and regulations.
