다문화사회와 헌법상 국민개념의 변용

국문 초록

현재 다문화와 외국인에 대한 많은 법체계가 존재하고 있다. 그러나, 이러한 법제의 기본적인 구성은 외국인이 차지하는 사회적 인구적 비중에 따라 외국인에 대한 시혜적 차원에서 배려하려는 기본적 사고가 바탕이 되고 있는 것으로, 기본적으로 사회구성원으로서의 우리와의 동질적인 측면에서 외국인을 우리 사회구성원으로서 자리매김 시키려는 법제의 형성은 아직도 미비한 상태로 거의 전무한 형태라고 할 수 있다. 따라서 기존의 법제도와 이념이 재한외국인에 대한 단순한 처우개선만의 문제가 아니라, 재한외국인이 자신의 능력을 충분히 발휘할 수 있도록 하고, 대한민국 국민과 재한외국인이 서로를 이해하고 존중하는 사회환경을 만들어 대한민국의 발전과 사회통합에 이바지하도록 노력할 수있는 체제가 되도록 헌법과 법제상 외국인의 문제를 국민의 개념과 연결하여 기본적으로 인간의 권리로서의 논의하여야 할 것이다. 여기서 국민주권이라고 하여 반드시 국적보유자라는 엄격한 의미로 해석되어야만 하는지 그 필연성에 대해서 국민국가와 다문화의 관계를 통해서 새롭게 정립하고자 한다. 즉, 국민개념을 역사적 관점에서 파악하면 국민개념은 ‘같은 법 아래에서 생활하고, 같은 단어를 사용하고 있는 하나의 국가, 국가의 모든 주민’이라고 하면 국민이라는 것은 국적 보유자에 한정되어야 하는지에 대한 검토도 필요할 것이다. 물론 국적개념은 근대의 소산이고 국내에서는 기본적 인권을 포함하여 국가와의 관계에서 법률상의 권리 의무의 범위를 국제적으로는 국가가 비호하는 인권의 범위를 밝히는 것으로 기능해왔다. 그러나 오늘날 인간의 대량이동과 세계화와 통합화의 추세와 함께 다문화사회에서 국적제도에 따른 국적으로 기본으로 한 인간의 권리에 대해서 인권보장을 위한 재검토와 국적제도 자체의 재검토를 위해서는 국적의 개념에 따라 국민의 범위를 좀더 세계화의 추세에 따른 변화에 한번 더 고찰할 필요가 있다. 따라서 본문에서는 다문화사회에 진입함에 따라 다문화에 대한 기본적 이해를 바탕으로, 국민주권의 이념에 바탕을 둔 국민의 개념의 역사적 과정과 국민국가와의 관계 속에서 현재 우리 사회에서 존재하고 우리가 통합의 대상으로 삼아 같은 시민으로 존재하는 외국인에 대한 헌법적 법적 문제를 고찰하는 것이 기본방향이 될 것이다. 내용상 다소 국민과 민족에 충실한 우리의 현행 헌법적 사고와 부합하지 않은 현실적인 문제가 있으나, 우리의 미래지향적 방향으로 우리의 나아갈 방향으로 그 제언을 대신하고자 한다.

영문 초록

Multicultural and international legal systems currently exist for many are. However, this legislation looks basically the same as a member of society is the lack of vision. Therefore, the existing principles of the legal system to help improve the treatment of foreigners in Korea, but in a matter of a simple, but their ability to foreigners in Korea to be able to exert enough, the people and the Republic of Korea Foreigners in Korea to understand and respect each other, creating a social environment, Republic of Korea development and social integration of the system to try to contribute to the constitution and laws on the issue of foreign nationals in connection with the concept of human rights, by default, as will be discussed. To do this, the national sovereignty, nationality holders on whether a new interpretation is needed. In addition, multi-cultural nation-state and would like to establish a new relationship. Today, the bulk of human movement and according to the trend of globalization and the integration of human rights for national human rights institutions for the review and reconsideration of their own needs. Thus, the body enters a multicultural society as a basic understanding of multiculturalism, the idea of national sovereignty based on the concept of a historical process of the people and the nation-state in relation to the presence in our society and the integration of our Sanya targets such as the presence of foreign citizens in the constitutional legal issues to consider will be the primary direction. Somewhat faithful to the people and content from people thinking of our current Constitution is not consistent with the real problem, but in the direction of our future move in the direction that our proposal is to instead. In this paper consists of a multicultural society and to face the reality of our society, multicultural society enters into the constitutional issues that occur while people, especially the people dealt with issues related to the expansion of the concept to interpret the Constitution as a policy proposal is to the direction.
