미국 민간조사산업의 특징 및 함의

국문 초록

민간조사산업은 세계적으로 민간경비의 중요한 한 영역으로 자리를 잡고 있다. 그러나 대한민국에서는 민간조사제도 도입 관련 여러 차례 법안들이 발의된 바 있으나 여러 가지요인들로 인해 계류, 철회 및 임기만료폐기되고 있다. 민간조사산업이 제도화 되지 못해 사회적으로는 불법적인 영업행위까지도 벌어지고 있는 실정이며, 학계에서도 민간조 사업의 도입에 관해 활발하게 연구를 수행하고 있다. 이 연구에서는 이러한 관점에서 미국의 민간조사산업의 선진국인 미국의 특징을 살펴보고자 하여 참고자료를 제공하고자 하였다. 미국 민간조사산업에서는 법적, 재정적, 개인적 문제에 있어서 사실과 정보를 찾아내고 사람들의 배경조사, 실종자 추적, 컴퓨터범죄 조사, 중요인사 보호, 범죄문제의 해결 등의 역할을 수행한다. 연방제국가로서 자치주의적 성격에 따라 각 주마다 민간조사산업 또한 자격 및 요건, 시험제도 및 면허, 업무범위 등 차이를 보이고 있다. 미국에서 활동하고 있는 민간조사원은 5만~6만여명으로 추산되며, 미국 민간조사원들의 평균수입은 2010년의 경우, 연봉 42,870달러였다. 민간조사원의 자격 요건은 미국 시민 여부, 전과, 품성, 연령 제한, 시험이나 이수과정, 경력 연수 등이다. 또 민간조사원들에게 요구되는 자질은 커뮤니케이션 능력, 정직성, 탐구심, 문제해결 능력 등이다. 민간조사원들에 대한 고용은 2010년에서 2020년까지 21% 정도 성장할 것으로 기대되는 등 미국 내 직업군의 평균 성장률에 비해 빠른 속도로 발전할 것이며, 미래 성장산업으로서 그 역할을 다해낼 것으로 판단된다.

영문 초록

Private Investigation Industry has consolidated its position as an important domain of the private security industry in the world. In Korea, although various legislations were motioned to introduce the private investigation system, they are postponed, withdrawn or disposed of as their temporary enforcement deadline expired due to a number of factors. The reality is that the Private Investigation Industry is engaged even in illegal sales activities in the society since it is not systemized. The academic community is conducting research on the adoption of the private investigation industry in an active manner. From this respect, this research sought to provide the reference material by examining the characteristics of the US which is an advanced nation when it comes to the Private Investigation Industry. The Private Investigation Industry in the US plays roles such as uncovering truth and information concerning legal, financial and personal problems, and plays roles such as investigating people’s background, tracking down people who disappeared, investigating computer crimes, protecting key dignitaries and solving criminal issues. Since the US is a federal nation, there is a difference by the state in terms of the qualifications, terms, testing system, licensing and scope of the work due to the autonomy of each state. It is estimated that the number of private investigators who are active in the US, amounts to 50,000 to 60,000. Average income of the Private Investigators in the US was 42,870 USD per annum in case of 2010. As for the qualifications for the Private Investigator, they are US citizenship, absence of criminal record, character, age, test, completion of training program and experience. Moreover, qualities required of Private Investigators are communication skill, honesty, investigative ability, and problem-solving ability. Hiring of Private Investigator is expected to increase by 21% from 2010 to 2020. Likewise, this occupation is likely to increase faster than the average growth rate of other occupations in the US, and it is expected to fulfill its role as a future growth industry.
