일본의 결혼이민자 복지 정책

국문 초록

2003년 현재 일본 국내에서 이루어진 74만여의 전체결혼 건수 중 4만여 건을 차지하고 있는 국제결혼 중, 특히 외국인으로서 일본에 체재하고 있는 여성들은 언어문제, 일본의 법과 제도에 대한 무지, 지원체계의 부족, 이혼 후의 체류자격문제, 이혼조정이나 재판시의 통역문제 등 복잡한 절차로 인해 매우 약한 입장에 놓이게 되고, 국제결혼을 통해서 태어난 아이가 차별을 받는 현상도 나타나고 있다. 결혼이민자들에 대해 일본당국은 사회복지 수혜대상을 한정시키고 있다. 수혜대상의 조건이나 자격에 관한 우선순위는 첫째, 귀화 등의 과정을 통해 일본국적을 취득한 사람, 둘째 재일코리언과 닛케이진 등과 같은 영주자 및 정주자, 입관법에 근거한 정규 입국자 순이며, 입관법에 위반되는 비정규입국자 혹은 불법체류자는 수혜대상에서 제외되고 있다. 일본국적을 취득한 사람이나 영주자 및 정주자, 정규입국자가 받을 수 있는 복지내용은 크게 사회보험, 생활보장 등으로 나누어지고, 사회보험으로는 건강보험법 혹은 국민건강보험법, 후생 연금보험법, 국민연금법, 고용보험법, 산재보험법, 개호보험법의 적용을 받게 된다. 또한 사회수당으로 아동부양수당법, 특별아동부양수당 등의 지급에 관한 법률, 아동수당 등의 적용을 받는다. 그 외에도 일본 국내의 사회복지법, 주택보장법 등의 적용도 받게 된다. 하지만, 이 사회보험은 지출의 증가와 수혜자가 느끼는 불공평감이 그 문제로 지적되고 있다. 생활보호 혹은 공공부조에 관한 생활보호법은 외국인을 그 적용대상에서 제외시켰으나, 이를무보호 상태로 방치하는 것은 인도적으로 허용이 되지 않는다는 이유로 행정조치를 통해 이 법을 외국인에게도 준용하여 사실상의 보호를 하고자 하였다. 공공부조의 종류는 생활부조, 교육부조, 주택부조, 의료부조, 개호부조, 출산부조, 생업부조, 장제부조 등이 있다. 그 외에 지방자치단체가 독자적으로 취할 수 있는 조치가 있는데, 이는 국가 혹은 정부가 곤궁한 외국인 구제의 제1차적 책임을 지방공공단체에 부과하고 있음을 보여주는 것이다. 그러나 외국인에 대한 급부는 난민조약과의 관계에서 정책적으로 급부를 보장한 것이거나 혹은 단순히 은혜적으로 부여한 것이라고 생각한다. 한편, 다문화·공생을 위해 외국인에 대해 행해지는 사회복지는 일본사회 자체의 변화추구, 다언어·다문화 서비스시스템의 충실화, 일본어 교육 프로그램의 확충, 서비스기관이나 조직에 의한 외국인 지원, 보건·의료·복지 전문가의 연수, 시민대상 타문화이해 강좌 등이 있다.

영문 초록

In the year of 2003, 40 thousand marriages out of the total 740 thousands made in Japan were international ones. In Japan, these marriages also reveal numerous problems. These put the marriage immigrants in a very vulnerable position and consequently leaving their children in neglect and discrimination. In Japan, the social welfare systems are limited to marriage immigrants to a certain set of qualifications. First, they should acquire the Japanese nationality through naturalization and second, it is in order of permanent residents including Nikkeijins(Japanese descendents from Latin America) and zainich Koreans(Japanese Koreans) and regular immigrants under the Immigration Control and Refugees Recognition Act. Overstayers and irregular immigrants are excluded from the beneficiaries. The social insurances work under the National Health Insurance Act, Welfare Pension Insurance Act, National Pension Act, Labor Insurance Act, and others. Social allowances are under the influence of Childcare Allowances Act, Act on Special Childcare Allowances Provisions and thereof, etc. Besides, social welfare laws and Housing Security Act also apply to the immigrants. Currently, criticisms on the social insurances are made regarding the increase of spending and unbalance among beneficiaries. The Livelihood Protection Act has excluded aliens in planning public allowances for livelihood. However, criticisms were raised against living them out of humanitarian protections and an administrative measure was taken to apply the law to aliens with adaptation. Public allowances include allowances for livelihood, education, housing, medication, maternity, etc. Other measures are taken in the local governments own discretion. This proves that the central government leaves the primary responsibilities to protect aliens to the local governments. These benefits, however, were made available policy-wise in fulfilling the refugee agreements of the Japanese government or sympathetically. There are still programs devised in multicultural approaches such as language programs for foreigners, training of counselors and welfare services experts, classes for understandings of foreign culture for the Japanese and efforts to diversify the Japanese society.
