이주아동의 법적 지위와 인권보장에 관한 소고

국문 초록

본 연구는 외국인근로자의 증가 및 장기 체류에 따라 결혼ㆍ출산ㆍ중도입국 등을 통해 이주아동의 수가 급격히 증가되고 있는 현실 속에서 이주아동의 심각한 인권침해문제를 체계적으로 파악하고, 이에 대한 법제개선 및 정책방향의 제시를 목적으로 하였다. 연구결과, 이주아동의 급격한 증가에도 불구하고 국내법제는 국제 인권규범을 제대로 반영하고 있지 못하는 실정이다. 그나마 등록이 주아동의 경우는 그 부모의 지위에 따라 일정한 범위 내에서 보호를 받고 있으나, 미등록이주아동을 위한 법제는 전무한 상태이며, 정책 또한 부처 간 분절되거나 혼재되어 미비한 상황이라고 할 수밖에 없다. 이러한 상황에서 이주아동의 법적 지위와 인권보장 문제는 이주아동이 기본권 주제로서 인정받지 못하고 법적 보호 밖의 존재로 전락되고 있다. 따라서 이주아동의 법적 지위를 강화할 수 있는 「이주아동권리보장법」의 필요성을 제기하고, 이주아동의 인권보장을 위해 영주권 확대적용, 학습권 보장, 건강권 보장 등에 관한 관련법을 개정하여 적용할 필요가 있다.

영문 초록

The number of immigrant children has been rapidly growing in line with the increasing number of foreign(immigrant) workers, their long-term stay in Korea, marriage immigrants, birth, and immigrant workers’ children who are accompanied by them. This thesis deals with serious abuse of human rights to those immigrant children and suggests how to iron out the problems by means of legislative improvement and policy direction. As a result of study, it is found that, in spite of the increasing number of immigrant children, legislative system of Korea does neither meet the requirements of International Covenants on Human Rights nor reflect the Covenants at all. For registered immigrant children, they can be protected within some extent granted to the status of their parents. But the problem is about unregistered immigrant children, because there is no legal system at all to protect them from any possible abuse of human rights. Furthermore, government’s policies are broken off or mixed among departments, showing the absence of systematically-established policies. In these circumstances, legal status and human rights of immigrant children are not adequately guaranteed or recognized as an entity of basic human rights, and they are regarded as a being beyond the boundary of legal protection. So, this thesis presents the necessity of ‘The Security Act of Immigrant Children Rights’ that can strengthen their legal status in Korea, and the propriety of having to revise the laws related to permanent residency expansion, right of learning, and right of health for the security of immigrant children’s human rights.
