영문 초록

The modern statutory liability for animals replaces the ancient rules of the common law, but to a large extent follows its structure. While some aspects of the law may seem primitive in these days of the dominance of negligence, this is not so, for the law provides relatively simple and straightforward rules for what is often minor damage or injury. However, some animals cause very serious injury, and the modern tendency to keep ferocious breeds of dog has led to the demand for more stringent laws, and this control has so far been effected by use of the criminal law. However, it may be argued that there should be strict liability for injury caused by dogs, for not only do they cause a large number of injuries but also it seems strange that if a human being is attacked by a dog he must prove knowledge of this propensity on the part of the keeper, but if a sheep is attacked liability is strict.
