상표적 사용과 그 요건

국문 초록

상표적 사용은 상표법이 정하는 요건을 모두 갖춘 상표의 사용행위이다. 상표의 상표적 사용이라고 함은 상표법상 상표권의 정당사용 또는 상표권의 침해라는 효과를 인정받기 위하여 필요한 요건을 모두 갖춘 상표의 사용을 말한다. 이러한 상표적 사용은 상표권자의 독점사용권과 배타권 모두에 관련된다. 상표권자는 정당사용을 인정받기 위하여 상표적 사용을 하여야 한다. 제3자가 상표권을 침해하는가 아닌가는 제3자가 상표적 사용을 함으로써 요건을 갖추게 되고 비로소 상표권자에게 금지청구권 또는 손해배상청구권이 인정된다. 상표권자가 상표적 사용을 하는 것과 배타권과 관련하여 제3자가 상표적 사용을 하는 것과는 그 요건에서 차이가 있을 수 없고, 제3자는 상표적 사용을 할 권한이 없다는 점이 다를 뿐이다. 상표적 사용의 요건은 상표법이 정하는 바에 따른다. 상표법이 정하는 상표적 사용의 요건은 상표사용의 주체적인 면, 상표 사용이라고 하는 행위적인 면, 상품이라고 하는 행위객체적인 면, 그리고 식별력이라고 하는 상표자체의 면에서 각각 살펴보아야 한다. 이러한 요건이 명확하면 할수록 상표적 사용여부의 판단은 더 쉬워진다고 할 수 있을 것이다.

영문 초록

The just use of trademark assumes that it qualifies all requirments, and this safeguards the effectivness of trademark law, and fair use against its infringement. First, the use of trademark as a trademark is related to its owner's right to monopolize the trademark. The use of trademark as a trademark is criteria whether the owner of trademark uses his or her trademark fairly or not. If the owner uses the trademark unfairly, the registration of the trademark could be canceled. Second, the use of trademark as a trademark is also related the right to prevent other peopl's use of the trademark. Whether a third party infringes the trademark owner's right or not is judged depending on whether the third party uses the trademark as a trademark. There is no difference between the owner's use of trademark as a trademark and the third party's use of that. The only difference is that the owner has the right to use the trademark and the third party has not. The qualification of the use of trademark as a trademark is based on the trademark law. The qualification must be applied rigorously to the principle of legalty. The qualification of the use of trademark is assessed from the point of main agent, behaviour as a use of trademark, object as goods and the discrimination of the trademark. The clearer the qualification is, the easier the distinction of the use of trademark from other use of trademark.
