국문 초록

정당이라 함은 국민의 이익을 위하여 책임 있는 정치적 주장이나 정책을 추진하고 공직선거의 후보자를 추천 또는 지지함으로써 국민의 정치적 의사형성에 참여함을 목적으로 하는 국민의 자발적 조직을 의미한다. 현대 헌법국가에 있어서의 정당은 국민과 국가를 잇는 연결매체로서 민주적 기본질서의 중요한 구성부분이 되었다. 정당은 국민의 정치적 의사형성과정에 참여할 뿐만 아니라, 정부와 국회의 핵심적인 공직을 임면하는 데 있어서 결정적인 역할을 한다. 나아가 정부의 정책결정에 직접 영향을 미치거나 영향력을 행사함으로서 국가적 의사형성에 있어서도 결정적적인 영향을 미치게 된다. 따라서 정당은 무엇보다도 당내의 민주화가 이루어져야 한다. 특히 국민대표를 선출하는 선거에 있어서의 정당의 민주화는 매우 중요하다고 할 것이다. 그러므로 정당은 후보자추천에 있어서 단지 공직선거법에서 규정하고 있는 규범의 준수뿐만 아니라 새로운 민주적 정치질서를 형성하는 역할도 다하여야 할 것이다.

영문 초록

Political parties is a voluntary conformation and proceed with responsible political allegation or policy, and recommendation to support a candidate of public office election for advantage of nation. The political parties of modern Constitution have special role which is connecting people within a country and become important part of democratic society. Political parties actively participates in the process of appointment of superior official in the executive branch and the legislative and also political parties play important part of political decision Therefore, democratization within a party is so important. Specially, it is very important that democratization of the process and participation in inter-election for choosing nation delegates. Therefore, political parties should keep not only the public office election law but also make best effort to form new democratic political etiquette and culture in candidate recommendation process.
