영문 초록

In this paper, I tried to compare the controversy on law on ethnic Koreans abroad and to provide some reasons for the revision of the law. Some argue the revision of the law but others argue the abolition of it. According to Ministry of Foreign Affairs and Trade and some scholars, the law should be abolished because the law includes racial discriminative clauses based on jus sanguinis. They say that it is possible for ethnic Koreans abroad to receive favors by the present laws. Howver, their insistence can be criticized by historical background that the severe colonial rule caused the Korean diaspora to all over the world. It is not that law on ethnic Koreans abroad is racial discriminative and is that Korean migrants and emigrants before 1945 were the by-product of racial discrimination and infringement of human rights. Koreans living in China and other countries should be given preferential treatment because, in fact, they are put in the dual citizenship ; they and their ancestors had no freedom of deserting their own nationality. If the Korean government gave Korean nationality to Koreans in Japan when the relationship of Korea and Japan was normalized in 1965, why does it not give Korean nationality to ethnic Koreans in China and Russia(USSR)? Another meanings of law on ethnic Koreans abroad are as below. First, the law can help ethnic Koreans when they are discriminated or even in crisis as minority wherever they are. Second, the law can help ethnic Koreans remain national identity and culture. Third, it can promote the inter-relationship of ethnic Koreans abroad and Koreans living in Korea proper. In this respect, Jo Unggyu, a lawmaker, proposed the Revision Bill of the law. He explains that this law is a kind of affirmative action and can be executed for a limited period of time until the discrimination against ethnic Koreans abroad disappears, at least, in Korea. While the National Assembly is supposed to finish the revision of or abolish the law, I agree with Jo's total solution that aims to grant the same privilege to all ethnic Koreans.
