국문 초록

本文从法律移植的立场分析了中国反家庭暴力制度构建的历史，并对中国反家庭暴力制度建设中内藏的传统因素作了深刻的分析。作者认为，中国历史中重视家庭价值的传统既是官方也是民间能够迅速接受国外反家庭暴力法律思想的历史文化基础，也是中国建构反家庭暴力立法的中国因素。但也正是这种传统，使得我们对家庭暴力的制度建设与国外建立在社会性别和人权之上的反家庭暴力理论之间存在一定的差异，在现行法律中表现为容易在家庭与个人之间抹煞个体的利益。因此，在尊重传统的家庭价值观的同时，如何消除社会中“支配妇女和儿童”的权力机制，实现个体在婚姻家庭领域的法律平等将是长期的课题。

영문 초록

The purpose of this paper is to analyze the history of institutional arrangement of anti-domestic violence in China from the view of legal transplantation, and to illustrate the internal traditional factors. It holds that the tradition that we Chinese pay much attention to the family is not only a historical and cultural foundation on which the mass can accept quickly the idea of anti-domestic violence law from outside, but also the element that makes it a legislation. However, it is also this tradition that makes certain differences between the practices of anti-domestic violence in China and the theories of anti-domestic violence in West, which focus on the gender and human rights. And these differences make it easy for the existing laws to neglect the individual’s interests. Therefore, it will be a long-term issue to break the system of “dominant women and children”, to achieve the legal equality between individuals in the field of marriage and family, while respecting for the traditional family value.
