루마니아-우크라이나간 흑해 해양경계획정 사건에 관한 분석 및 평가

국문 초록

2009년 2월 3일 국제사법재판소(ICJ)는 루마니아 대 우크라이나 간의 세르팡섬(Serpent's Island, Snake Island)을 둘러싼 흑해에서의 해양경계획정 사건에 대한 판결을 하였다. 동 사건은 1997년 2월에 체결된 양국간 우호조약(the Treaty on Good Neighbourliness and Co-operation)에 따라 1998년부터 6년간의 협상끝에 결국 2004년 루마니아가 제소하였고, 이에 양국이 이를 수용하여 재판소가 소송을 진행하게 되었다. 2004년 9월 13일 루마니아는 우크라이나를 상대로 국제사법재판소(ICJ)에 제소하였으며, 소송제기 시, 루마니아는 자국과 우크라이나간에 작성된 1997년 2월 교환각서에 의한 추가합의 제4(h) 규정에 따라 재판소의 관할권을 구하고자 하였다. 본 사건에 있어 경계획정 대상수역은 북해 북서쪽에 위치한 흑해로, 이는 다다넬스해협, 마르마라 및 보스포러스 해협으로 둘러싸인 지중해와 연결되어 있다. 흑해는 수면 면적이 432,000㎢이며, 흑해 북서쪽에는 다뉴브 델타 동쪽에서 약 20해리 떨어진 거리에 세르팡도서라 불리는 섬이 있는데, 본 도서는 고조시 수면 상에 있으며 그 면적이 0.17㎢이고 둘레는 약 2,000m이다. 본고에서는 양국간 해양경계획정에 관한 국제사법재판소의 판결내용을 사안별로 즉, 해양경계획정시 도서의 효과, 해양경계획정절차 및 방식문제, 해양경계획정에 관한 당사국간 기존합의의 효력, 관련해안의 역할 문제, 관련사정이 해양경계에 미치는 영향 및 비례성 문제 등을 분석한 후 향후 동 판결이 한일간 동해에서의 경계획정 및 독도문제에 미칠 영향 또는 시사점을 제공해줄 수 있는가를 도출하고자 한다.

영문 초록

On 3 February 2009, the International Court of Justice rendered its Judgment in the case concerning Maritime Delimitation in the Black Sea (Romania v. Ukraine). According to the Treaty on Good Neighbourliness and Co-operation of 2 June 1997, Romania filed in the Registry of the Court dated 13 September 2004 after negotiations (two times) with Ukraine since 1998. The maritime area which the delimitation in this case is to be carried out is located in the north-western part of the Black Sea. The Black Sea is an enclosed sea connected with Mediterranean Sea by the Straits of Dardanelles, the Sea of Marmara and the Bosphorus straits. The Black Sea has a surface area of almost 432,000㎢. In the north-western part of the Black Sea, approximately 20 nm to the east of the Danube delta, there is a Serpents' Island having a surface area of almost 0.17㎢ and a circumference of almost 2,000m. This paper examines and analyzes major contents of the Judgment such as legal effect of an island in the maritime boundary delimitation, delimitation methodology, establishment of the provisional equidistance line, relevant circumstances, relevant coasts, relevant maritime area and the disproportionality test. And then, the paper suggests possible ways and comments to be applied to solve the Dokdo issue between Korea and Japan and the maritime boundary delimitation in the East Sea on the basis of the Judgment.
