독일 대학의 자율성 확대를 위한 개혁 동향의 비판적 고찰

국문 초록

이 논문은 최근 독일대학의 자율성 강화를 위한 개혁 동향을 살펴보고, 이를 자율성의 본질에 비추어 비판적으로 검토하는 것을 목적으로 한다. 독일대학의 여러 문제를 해결하기 위해서는 대학의 자율성을 강화해야 한다는 주장이 1990년대부터 초부터 대두되기 시작했다. 이를 제도화한 것이 1998년 고등교육기본법의 개정이었는데, 그 이후 다양한 정책과 제도가 추진되었다. 계약을 통한 성과 중심의 대학운영, 새로운 법적 형태의 대학 허용, 업적에 따른 교수의 급여 차이를 가능하게 하는 보수체계 개편, 학생 선발에서의 대학의 권한 확대, 수업료 징수를 통한 재정개혁, 고등교육기본법의 폐지 등이 그 구체적인 내용이다. 이들은 대학업무 수행상의 자율을 넓혀주고 있다. 그러나 결과 중심의 통제, 학문적 요구보다는 사회경제적 요구에의 충실, 계량적 평가를 통한 교수의 연구와 교육성과 통제, 학생의 학습권 침해, 사회적 취학계층의 대학진학률 저하, 지역 간 대학 격차 확대 가능성이라는 문제들을 가지고 있다 대학의 자율은 대학행정상의 자율과 교수의 연구와 교육의 자율로 구분할 수 있다. 지금까지의 독일대학의 자율성 확대를 위한 개혁동향을 대학 자율성 자체의 관점에서 검토해보면, 한편으로는 대학행정의 형식과 과정상의 보다 많은 자율을 획득했지만, 다른 한편으로 교수의 학문과 교육의 자유라는 보다 본질적인 자율성은 오히려 약화시킬 가능성이 있다고 판단된다.

영문 초록

This study attempts to critically review the reform movement in German universities in terms of university's autonomy. Since the mid of 1990's, the enlargement of university's autonomy has been proposed to overcome many problems of German universities. The revision of University Basic Law in 1998 institutionalized these proposals. Afterward many university policies have been practiced such as the university management based on the contract between universities and the state governments. the permission of new lawful university type, the restructuring of professors' wage scheme, the enlargement of university's right to select students, financial reform through charging tuition fee, the repeal of University Basic Law. These policies enlarge the university's autonomy in the practice of university affairs. These policies enlarge the university's autonomy in the practice of university affairs. However, they also yield many problems: controlling university on the basis of products, prioritizing the social and economic needs over academic requirement, controlling research and education by means of quantitative evaluation, limiting students' right for learning, lowering admission rate for students of disadvantaged class and female students, increasing the gap among universities in advantaged and disadvantaged region. The autonomy of university can be categorized into the procedural and substantial autonomy. This reform movement can be appraised as the extension of procedural autonomy of university administration in one side. However, it may result in weakening university's substantial autonomy to secure freedom in research and education in the other side.
