영미법상 선박의 속력과 연료소모량 유지에 대한 선박소유자의 의무에 관한 연구

국문 초록

최근에는 유류가격의 등락이 심하기 때문에 선박의 속력과 연료소모량의 증감은 운항수익에 매우 중요한 영향을 미친다. 따라서 선박소유자가 정기용선계약서상 명시된 선박의 속력과 연료소모량에 대한 담보를 위반하였을 경우에, 정기용선자는 이에 대하여 손해배상을 청구하거나 때로는 용선료를 다시 조정하기도 한다. 정기용선계약에서 선박의 속력 및 연료소모량과 관련한 분쟁은 매우 빈번하게 발생하고 있으나, 성질상 손해배상의 범위가 완벽하게 입증되기는 용이하지 않다. 따라서 관련 분쟁은 중재 또는 법원에서 보다는 당사자 사이의 협상에 의하여 해결되는 경우가 많다. 정기용선계약의 중재지는 일반적으로 영국 또는 미국으로 되어 있고 준거법도 영국법 또는 미국법으로 지정되어 있으므로, 본 논문은 영미판례를 분석하여 영미법에서의 선박의 속력과 연료소모량에 대한 분쟁을 검토하고자 한다. 본 논문에서는 선박의 속력과 연료소모량에 대한 분쟁이 발생하였을 경우에 손해배상청구의 가능성 및 청구범위에 대하여 연구함으로써, 용선계약 실무자가 관련 법률지식을 습득하는데 도움이 되고자 한다.

영문 초록

The increase and reduction of vessel's speed and fuel consumption have an important affection upon the profit and loss of the voyage concerned, especially due to the rapid increase of oil price. Accordingly, the Time Charterers lodge a claim or, sometimes, readjust the hire in this regard, in case the Shipowners breach the warranty about vessel's speed and fuel consumption in the time charter party. Although the disputes about vessel's speed and fuel consumption occur most frequently, it is too difficult for the claim amount to be approved with perfect evidences. Accordingly, the disputes tend to be solved by negotiation between the Shipowners and the Time Charterers rather than in the arbitration or in the court. As the arbitration or jurisdiction in the time charter party is, in most cases, in England or in America, I will review the disputes about vessel's speed and fuel consumption through the analysis of the cases of the England and America. This study is significant in that by studying the possibility and amount of the claim, it will contribute to assist people in chartering business to acquire the relevant knowledge in legal aspects.
