국문 초록

한국과 중국은 1996년과 1998년에 각각 EEZ를 선포하였고, 그 체제에 부합되도록 2000년에 어업협정을 체결하였으며, 그 어업협정은 2001년에 발효하였다. 한국과 중국이 처음 체결한 어업협정이 발효한 이후 8년간의 시행결과를 평가하고, 어업협정이 갖는 법적 효과에 관하여 논의하였다. EEZ 상호입어실적은 한국수역에서의 중국어선단의 어획량이 중국수역에서의 한국어선단 어획량의 10배였는데, 이것은 한국수역에 대한 중국 어업세력의 조업 의존도가 그만큼 높다는 것을 의미한다. 그리고 한국 수역에서 중국어선단의 불법어업활동이 극심하다는 문제가 있기는 하지만, 대체적으로 양국 간에는 새로운 국제어업질서가 정착되고 있음을 알 수 있다. 한편, 잠정조치수역과 현행조업질서유지수역의 수산자원 관리는 성공적이지 못하였다. 그러나 어업협정은 쌍방 체약국의 잠정적 EEZ 범위를 확인하는 효과를 발휘하고 있다.

영문 초록

Korea and China promulgated EEZ in 1996 and 1998 respectively, and two countries concluded fisheries agreement corresponding to that regime in 2000 and the agreement entered into force in 2001. In this article the 8 years enforcement result of the Korea-China Fisheries Agreement was analysed and discussed on the other legal effect of the fisheries agreement. Total catch of the Chinese fishing fleet in the EEZ of Korea was 10 times than that of Korean fishing fleet in the EEZ of China, it means that the reliance of the Chinese fishing fleet upon the EEZ of Korea is higher than that of Korean fishing fleet upon the EEZ of China. Nevertheless, the new international fisheries order is being founded between both parties. On the other hand, the fisheries resources management within the Interim Measures Zone established in the Yellow Sea and the white zone established in the East China Sea was not successful at all. But the fisheries agreement is displaying the verification effect on the interim EEZ range of both parties.
