2008년도 대륙붕한계위원회 문서제출 사례분석 및 평가

국문 초록

연안국의 대륙붕은 영해 밖으로 영토의 자연적 연장에 따라 대륙변계의 바깥끝까지, 또는 대륙변계의 바깥끝이 200해리에 미치지 아니하는 경우, 영해기선으로부터 200해리까지의 해저지역의 해저와 하층토로 이루어진다. 연안국은 일정한 조건과 절차에 따라 자국 대륙변계의 외측한계를 설정해야 하는바, 특히 200해리 이원 대륙붕을 향유하는 국가는 자국 대륙붕 외측한계에 관한 정보를 2009년 5월 13일까지 유엔 대륙붕한계위원회에 제출해야 한다. 이 후, 동 위원회는 연안국의 제출 문건을 심사하고 이들 국가의 대륙붕 외측한계에 관하여 권고를 하게 된다. 상기의 제출 의무 결정에 따라 2007년 12월 31일까지 9개 국가가 문서를 제출하였고, 2008년도에는 바베이도스, 영국, 인도네시아, 일본, 모리셔스 및 세이셀, 수리나메, 미얀마 등 7개 국가가(1개는 공동제출) 자국 200해리 이원 대륙붕 외측한계에 대한 문서를 제출하였다. 본고는 2008년에 제출된 7가지 사례를 유엔해양법협약, 대륙붕한계위원회 의사 규칙 및 동 위원회 과학 및 기술지침 등을 근거로 분석․평가하고자 한다. 이 점에 있어 본 연구는 유엔이 지정한 기간 내에 연안국이 제출해야 하는 의무에 있어 발생되는 법적․정치적․경제적․기술적 문제점 등을 지적하고 이 문제를 해결하기 위한 실질적인 방안을 모색하고자 한다. 또한 이러한 분석을 기초로 동중국해에서 200해리 이원으로 확장되는 대륙붕에 관하여 인접 또는 대향국가들과의 법적․경제적 및 정치적 입장을 고려하여 우리 정부가 제출 문건에 관하여 취할 수 있는 바람직한 방향을 제시하고자 한다.

영문 초록

The continental shelf of a coastal state comprises the seabed and subsoil of the submarine areas that extend beyond its territorial sea throughout the natural prolongation of its land territory to the outer edge of the continental margin, or to a distance of 200 nautical miles from the baselines, or to a distance beyond 200 nautical miles from their baselines to states with continental shelves extending beyond 200 nautical miles. Such a coastal state must establish the outer limits of its continental shelf through application of formulae lines and within constraint lines in relation to the outer edge of the continental margin. Also, information on the limits of the continental shelf beyond 200 nautical miles from the baselines must be submitted to the CLCS until 13 May 2009. And then, the CLCS examines the submission by the coastal states and makes recommendations to the coastal states on matters related to the establishment of the outer limits of their continental shelf. In accordance with the above mandate of the CLCS, 7 coastal states, Barbados, UK, Indonesia, Japan, Mauritius and Seychelles, Suriname, Myanmar, submitted their continental shelf outer limits beyond 200 nautical miles in 2008. So, this paper studies all 7 cases and analyzes and evaluate them on the bases of legal documents such as the UN Convention on the Law of the Sea, Rule of Procedure of the CLCS, Scientific & Technical Guidelines of the CLCS. In this regard, the study points out several problems caused by the obligation to submit by the coastal states within the period designated by the UN and then suggests some practical solutions to solve that problems. In addition, it is hoped that this paper would suggest some desirable directions for submission by the Korean government in consideration of legal, economic and political positions of neighboring countries with regard to the continental shelf extending beyond 200 nautical miles particularly, in the East China Sea.
