스페인의 유류오염손해보상 법제에 관한 소고

국문 초록

유류오염손해 배상 및 보상에 관한 국제협약인 1992년 민사책임협약과 기금협약체제는 현재까지 성공적으로 운영되어 왔다고 평가되고 있다. 우리나라도 이들 협약을 수용한 유류오염손해배상보장법 제정을 통해 유류오염손해에 대한 배상 및 보상체제를 구축해 왔다. 유류오염손해 배상 및 보상을 위한 국제협약이 추구하는 것은 피해자에 대한 신속하고 충분한 배상 및 보상이다. 그러나 유류오염으로 손해를 입은 자가 국제협약에 의해 보상을 받기까지는 상당한 시간이 걸린다. 신속한 보상이라는 관점에서 보면 국제협약에 의한 보상체제는 기대한 만큼 효율적이지 못하다. 유류오염손해배상 및 보상처리에서 가장 효율적이었던 방법은 국가가 직접 손해를 사정해서 선지급한 프레스티지호 오염손해보상을 위한한 특별법에 의한 보상방법이었다. 이 연구는 프레스티지호 오염사고 보상을 위한 특별법에 대한 분석과 우리나라 허베이 스피리트호 특별법과 비교검토를 통해 우리나라 유류오염손해보상법의 문제점 및 개선방향을 제시하였다.

영문 초록

The international legal system mainly led by the 1992 Civil Liability Convention and the Fund Convention is appraised to be properly effected. Korea has also ratified those conventions and enacted the Oil Pollution Compensation Guarantee Act to implement them at the national and local level. The purposes of such international conventions are to ensure a rapid and proper compensation. However, the compensation system by international conventions seems to be ineffective to guarantee a rapid compensation because it takes a long time for a victim by oil pollution to be paid a compensation. The Spanish legislation in form of Royal Decree to manage the Prestige case is regarded as a most effective model for a rapid compensation, the point of which is that the state assessed the damage and made advance payments, previous to the definitive assessment by the IOPC Fund. In this article, the author review the The Royal Decree and comparatively analyze a special law to compensate the victims of the Hebei Spirit accident with that of the Prestige accident, and than provide a proposal of amending oil pollution compensation system in korea,
