국문 초록

인간은 행복을 달성하기 위해서는 어느 정도의 경제적 풍요와 국가의 민주성 및 범죄가 없는 안전한 사회가 유지되는 것은 당연히 전제가 되어야 한다. 이러한 전제를 보장하기 위해서 각종 제도 및 민사상의 분쟁해결방법을 마련하고 있는데 그 대표적인 제도가 경찰, 검찰, 법원제도가 있다. 그런데 사실상 국가의 공권력을 행사할수 있는 경찰과 검찰이 완벽하게 범죄의 예방과 진압을 행할 수 없고, 재판관의 판단역시 완벽하다고 할 수 없어 매년 일정한 비율의 미제사건이 발생하고 있다. 이러한 미제사건으로 인해 피해자는 마음에 깊은 상처를 지니게 되며 복수라는 명목으로 또 다른 범죄의 계획할 수도 있다. 또한 사회는 다수의 미제사건으로 인해 국민들이 법을 무시하고 나아가 법집행기관에 대한 불신으로 이어질 것이다. 그러므로 미제사건에 대한 피해회복을 위하여 현행법의 테두리 내에서 합법적이고 합리적으로 수행할 수 있는 사람이 반드시 필요하게 되는 것이다. 이 연구에서는 공인탐정에 대한 개념 분석과 발전현황을 고찰해 본 후 현재 우리나라에 있어서 공인탐정제도 도입의 필요성을 파악하고 공인탐정제도를 범죄의 예방과 진압을 위한 각종제도 및 민사 상의 분쟁해결 방법의 대표적인 제도인 경찰, 검찰과 법원제도에 결합가능성을 밝히고자 하는데 목적이 있다. 비록 탐정제도가 많은 문제점을 안고는 있겠지만 바로 이러한 탐정제도의 문제점을 효과적으로 극복하기 위해서는 어느 정도의 국가통제와 비자격자에 대한 실질적인 단속을 위해서라도 공인탐정제도는 반드시 필요하다는 입장이다.

영문 초록

It is necessary to live a happiness of human life easy street and safety society which are there is no crime. These should do by criminal justice system such as police, prosecutor, and court. These, however, criminal justice systems could do not perfectly. It makes people to discredit criminal justice system. These are the reason for having great demands for various private searches and collecting information activities, but it is still banned to supply of private investigation service in Korea. It is not easy to describe the system of private investigation service in most developed countries but they generally permit the private investigation system and have various methods to solve the side effects of that. Also they try to solve overall social problems such as protecting rights of citizens, preventing illegal cases and supplementation the limits of national investigation through charging to consumers. Thus, it is reasonable that Korean government should permit private investigation service and find the way to minimize the side effects of private investigation service instead of banning the service totally. This study shows actual conditions of operation of the licensed private investigation service system through comparative case in foreign countries: USA, Japan, United Kingdom, Spain, France, Australia. Consequently this study analysis of the concept about licensed private investigator, in addition, consider development of private investigation in Korea. It does so and it discusses to about the necessity of introduction of Korea model private investigation service system.
