방화범의 범죄동기에 관한 연구

국문 초록

  본 논문에서는 방화범의 동기를 미국의 국립강력범죄분석센터(NCAVC)가 규정한 「범죄분류편람(Crime classification manual)」과 Bartol의「범죄적 행태(Criminal behavior)」에 제시된 내용을 중심으로 그 유형을 구분하였다. 이에 의하면 방화범의 범죄동기는 반달리즘, 흥분, 보복, 범죄은닉, 이익, 극단주의적 신념, 병적 방화 등으로 분류할 수 있다.
  조사대상은 2001년 이후 최근 5년간 종합일간지 10개 신문에 보도된 방화사건을 중심으로 하였다. 그 결과 보복-동기 방화가 전체 방화사건의 절반 이상을 차지했으며, 이는 가정불화와 경제적 원인으로 홧김이나 앙심(불만)을 품고 이를 보복하는 수단으로 불을 지른 것이 대부분이었다.
  그런데 방화범은 정신적인 장애를 보이는 경우가 많고, 특히 보복-동기 방화범의 경우 반사회성 인격장애 혹은 정신분열증 중 망상증을 보일 가능성이 높은 것으로 나타났다. 이 밖에도 반달리즘-동기 방화범의 경우는 반사회성 인격장애의 증세를, 흥분-동기 방화범의 경우는 병적 방화의 증세를 보일 가능성이 높다.
  따라서 경찰이나 검찰 등의 수사기관이 방화범에 대한 수사과정에서 정신장애여부를 확인할 수 있는 MMPI 등의 검사를 실시하는 한편 방화범에 대한 별도의 교정프로그램의 개발이 시급하다. 또한 청소년 방화범에 대한 프로파일링 작업을 통하여 방화범의 특징을 파악하고, 방화동기를 억제할 수 있도록 정신심리적 대책 및 사회적 여건의 조성 등도 필요하다고 본다.

영문 초록

  This study categorized the types of arsonists" motivations, based upon 「Crime Classification Manual」stipulated by the National Center for the Analysis of Violent Crime and 「Criminal Behavior」written by Bartol. According to these references, arsonists" criminal motivations can be categorized into vandalism, excitement, revenge, crime concealment, profit, extremist and pyromania.
  The subjects were centered on the arson cases reported in 10 major daily newspapers for the recent 5 years since 2001. The result reveals that revenge-motivated arsons accounted for more than half of the total arson cases, and most of them were the fires set with anger or complaints from family conflicts or economic instability as revenge means.
  Many cases show that arsonists have metal disorders; especially, revenge-motivated arsonists have high possibility of antisocial personality disorder or delusion out of schizophrenia. It is highly likely that the vandalism-motivated arsonists have antisocial personality disorders, while excitement-motivated arsonists have pyromania cases.
  Therefore, it is urgently necessary to conduct MMPI test which enables investigators such as police or the prosecution to check criminals" mental disorders in the course if investigation, and to develop separate correction programs for arsonists. In addition, it is necessary to identify the characteristics of arsonists through profiling about juvenile arsonists, and to create psychological measures and social conditions to control arsonist motivation.
