일본의 경험에 비춰본 한국 국립대학법인화 작업의 평가

국문 초록

  한국에서의 국립대학 법인화 작업은 일본에서 2004년 이루어진 국립대학법인화를 모델로 하고 있는 듯이 보인다. 현재 한국에서는 국립대학 법인화에 관한 법안이 만들어져 국회에 상정되어 있다.
  이 논문에서는 일본에서 국립대학 법인화를 추진한 경과, 그 논거로 제시한점, 결과로서 나타난 국립대법인법의 주요 내용, 법인화 이후의 주요한 현황을 살피고 난 다음 그에 대한 비판을 살펴보았다. 비판은 주로 국립대학 법인화가 대학의 자치와 자율성을 훼손한다는 시각에서 나온다.
  이와 같은 일본에 관한 고찰을 토대로 하여, 한국의 법안이 일본의 국립대학 법인화에 관한 경험에서 어떤 문제점을 안고 있는지 살펴보았다. 역시 한국의 법안이 갖고 있는 가장 큰 문제점은, 어쩌면 일본보다도 더 대학의 자치를 훼손하고 있다는 점이다.
  대학의 자치는 한국 헌법상 인정되는 중요한 사항이다. 법안은 이를 너무 무시하고 있다. 그리고 경쟁을 우선시하는 신자유주의의 사고에 포로가 되어 대학을 너무나 경쟁으로 내모는 결과 지방의 군소 국립대학은 절름발이화 혹은 쇠락의 길을 걸어가지 않을 수 없다. 지방대학이 지역경제에서 차지해온 역할에 비추어 이것은 또 지역경제의 쇠퇴로 연결될 것이다.
  일본에서는 지금 국립대학법인화에 관한 많은 반대운동이 일어나고 있고, 조만간 제도의 수정이 꾀해질 것으로 예상되고 있다. 우리 법안은 일본의 경우보다 더 큰 문제점을 안고 있다. 국립대학의 진정한 발전을 위한 진지하고도 근본적 대책이 법안을 대신하여 나서야 할 때이다.

영문 초록

  Nowadays Korean government is set to accomplish the procedure of the incorporation of national universities(including colleges). It"s main content is to better an efficiency in the management of national universities, by which to alleviate the burden of the government.
  But among the OECD nations, S. Korea has the most inferior status in the amount of expenditures for higher education. Therefore we could say the incorporation of national universities is not a reasonable and proper policy. Besides that, it doesn"t comply to the principle of the autonomy of university, which includes more serious problems in it.
  Korean constitution Article 31 Clause 4 stipulates the autonomy of university, which is indispensible to get a academic freedom the Korean Constitutional Court acknowledged as one of the fundamental rights through cases. Now the bill for the incorporation of national universities is submitted to the National Assembly. It can"t find any accordance with the freedom or the autonomy of university as it has many contents severly damages them.
  In fact, the Korean bill for the incorporation of national universities has benchmarked the Japanese correspondent law. Japan has implemented the incorporation of national universities since 2004. But many criticisms have been spouting against it so that it is generally projected for it to get fundamental corrections in a near future.
  We have to have another precise review in consideration of the autonomy of university and the true meaning of the effective management. The experiences of Japan in the implementation of the incorporation of national universities may be very useful for it.
