국문 초록

  자기선택권과 다양성을 존중하는 현대 사회에서 개인적 자유를 신장하는 것이 발전이며 이를 실현하는 유력한 제도가 시장경제이다. 자유롭고 공정한 시장경쟁을 위해서 필요한 게임규칙을 만드는 기준의 하나로 존 스튜아트밀의 타자위해의 원칙(harm principle)을 제시하였다. 타자에게 해가 되지 않는 한 최대로 자유로워야 한다는 이 원칙에 따르면 시장경제활동 중 타자에 해가 되는 행위에 대해서는 이를 반칙으로 간주하여 정부가 규제할 수 있다. 한마디로 타자위해의 원칙은 자유시장경제에서 정부간섭의 필요성과 그 기준을 정하는데 있어서 매우 유효한 원리이다. 이를 분석하기 위하여 이사야 벌린의 ‘적극적 자유’와 ‘소극적 자유’를 소개하고 이중에서 모든 개인의 〈...으로부터 자유〉, 즉 소극적 자유를 정부가 보호하고 신장할 대상임을 밝힌다. 특히 타자위해의 전형인 “여우에 대한 자유보장이 양들의 죽음을 의미하는 경우”를 출자총액제한제도와 관련하여 설명하였다. 시장경쟁에서 타자 위해의 원칙을 적용하는 기준으로 재산권 침해, 이익추구 등 경제활동의 자유침해, 가격기구 훼손행위, 정보의 차단 등을 제시하였다. 마지막으로 이 원칙에 따라 정부 개입의 정당성과 그 한계 등을 설명하였다.

영문 초록

  In the modern society, which respects one’s own choice and diversity, enhancing individual freedom leads to social development. In this regard, market economy is one of the most competent and effective social systems to realize this goal. As a principle to set up the rules of game for fair and free market competition, John Stuart Mill"s ‘Harm Principle’ is useful. According to this principle, anyone can behave freely to the extent that he/she does not harm others. However, any behavior, which harms others, can be regulated by the government, regarding it as ‘violation of rule of game’. This harm principle is very effective in understanding the necessity of the government’s intervention and setting the criteria of such intervention. In order to analyze this principle, “positive freedom” and “negative freedom” by Berlin were introduced. Out of these two types of freedom, “negative freedom” is the one that should be protected and promoted by the government. In particular, the article links the harm principle with the policy setting the ceiling on total amount of share ownership. By applying the analogy of “freedom for the wolves has often meant death to the sheep”, the policy of share ownership is explained. Criteria to apply harm principle in market competition include violation of property rights, breach of others’ free market activities by pursuing one’s self-interests, damage on price mechanism and blockage of information.
