영문 초록

  Probation is more and more common form of criminal sentencing in Korea. Despite its wide use, probation has its dark side, because it suffers from a "soft on crime" image. That image is mainly due to the non-intervention to the repeated violation of probation conditions that occurs during the period of probation. For that reason it ought to be reformed the current korean probation system, otherwise the probation will be the subject of the intense criticism and maintain little public support. So this paper focuses on the development so called "back-up sanction" for the violation of a probation conditions. I suggest therefore in this paper following back-up sanctions, including the introducing of intensive probation supervision: extending the term of probation; modifying or enlarging the conditions; revoking of a part or suspended sentence.
