영문 초록

  The Permissible Emission Standards means the concrete permissible standard for emission of environmental pollutants in individual companies, which establishes the limits of "permissibility" and general public"s "tolerability" for the purpose of environment protection. When the company keeps the standard, however, it cannot be interpreted to be exempted from the civil liability. But, the standard has some implication of the offensiveness of private nuisance under section 217 of Civil Act because it is decided through the scientific researches.
  When it emits the environmental pollutants in excess of the standard, it may be regarded as an essential invasion under Private Laws. That is, the environmental pollutants in excess of the standard is a obvious basis of judgement for the seriousness of offensiveness. On the other hand, observance of the standard only means a "plain basis of judgement" of inessential offensiveness.
  The normality of land is judged on the basis whether the lands are used in similar ways in the inflicting lands. So the observance of the standard is "plain basis of judgement" of the normality of land.
  The invasion of the standard by excess emission would be "the clear basis of judgement" for preventiveness of invasion, and the observance of the standard would be "the plain basis of judgement" of the impossibility of preventiveness of invasion.
