영문 초록

  "Gestaltungsrecht" is a right which permits the holder to cause unilateral changes in one"s and/or other party"s legal relationship. The German legal term could be translated in English as a "right to change the legal relationship." Here the word "change" refers to "establish, alter, or extinguish." Typical examples of the Gestaltungsrecht are the rights to rescind, to retract, to revoke, etc.
  Many civil law scholars have paid particular attention to the Gestaltungsrecht because of its unilaterality and directness. Due to these unique characteristics, the Gestaltungsrecht becomes a useful tool in setting a legal relationship. For instance, a Gestaltungsrecht can be strategically included in the consumer protection act in order to give consumers a strong and unilateral power against big companies. In this perspective, it is worth pursuing a study on the Gestaltungsrecht.
