영문 초록

In 1990, Civil Conciliation Act was enacted. By this law, all kinds of civil cases, regardless the amount in controversy can be conciliated by the court in Korea. The conciliation procedure is presided by the conciliation judge or by the conciliation committee. The conciliation committee is composed of one judge and more than two layman professionals. Besides the above court annexed conciliation system, there are various kinds of administrative conciliation agencies in Korea. People can choose the procedure between the court conciliation and the conciliation by the administrative agencies. But the traditional people's conciliation is just a history in Korea. In comparison to the above Korean conciliation system, the people's conciliation procedure is still functioning in China. There are numerous people's conciliation committees in China(amounts about 94,4000) which settle the civil disputes in their outset stages in their vicinity and thus lessen the burden of the courts. Recently (November 2002). The Supreme people's Court of China revised the Rules Which regulates the people's conciliation procedure to promote its function and to facilitate its use among the people.
