영문 초록

Currently the rapid development of press media facilitates expression of opinions. The freedom of expression is ensured to the highest degree as an important Constitutional Right in developed democratic nation. In cases of conflict between the protection of human integrity and freedom of expression, the issue of the considerable reason of the defamatory publication must be regarded as an essential factor in deciding the protection of expression. The Supreme Court of Korea's requirement that a defendant prove media was not negligent the objective illegality component of the Supreme Court's reasoning. But this requirement would be better positioned in the purview of subjective fault.
