국문 초록

본 논문은 통일한반도의 정부형태에 있어 논의될 수 있는 하나의 모형으로 미국의 연방제도를 기본으로 하면서 한국의 정치현실을 고려한 형태의 모형을 제시하려 한다. 이를 위해, 본 논문에서는 미국 연방주의의 정치, 역사적 배경에 대한 고찰과 함께 연방제의 발전과정에서 고려되는 요소들을 크게 세 가지(핵심 이슈, 개인에 대한 헌법의 적용, 개방적 일원화로서의 연방주의)로 구분하여 제시하고 이러한 요소들이 어떻게 통일한반도의 정부의 정책 및 기본제도를 형성하는데 이바지 할 수 있는가에 대한 논의를 하고자 한다. 본 논문에서 제시하는 정부 형태에서는 유교와 자유민주주의를 바탕으로 하고 있는 한국의 정치문화, 통일한반도의 안보 및 군사문제에 있어서의 주권 귀속, 북한지역의 경제발전을 위한 조직, 그리고 북한의 경제적 지원에 대한 지원국가의 무역상 최혜국대우 지위부여 등을 핵심적 사안으로 고려하고 있으며 이와 관련한 사회복지제도, 북한의 국유자산의 사유화문제와 남한의 재벌개혁 등과 같은 정책적 과제에 대한 문제도 아울러 다루고 있다. 위와 같은 핵심요소에 대한 고려를 바탕으로 내다본 통일한반도정부의 형태는 대략 아래와 같을 것으로 본다. 첫째, 통일한반도의 제헌의회는 새로이 개편된 지방행정구역에 기반 하여 각 지방별로 동수가 참여하는 형태로 될 것이며, 둘째, 현재의 행정기구는 상호 적대적 국가기구의 폐쇄를 포함한 강도 높은 개혁을 통해 재조정될 것이다. 셋째, 각 지방정부는 자체적으로 지사 및 지방의회의원을 선출하나 새로이 국가에서 선출된 임기제의 행정수장 및 의원들을 아울러 두게 될 것으로 본다. 이외에도 본 논문에서 제시하고 있는 모형은 입법, 사법 및 지방자치를 비롯한 다양한 문제에 대한 논의를 하고 있다.

영문 초록

This paper proposes the outlines of a federal model for Korean government after unification. It utilizes the American system of federalism as a basis for the model, together with appropriate modifications for the Korean political case. After surveying the political-historical background of American federalism, it identifies three central characteristics of its development (bracketing of divisive issues, operation of the constitution on individuals, and the idea of federalism as an open equation). The paper then elaborates how these characteristics might be utilized to construct the basic institutions and policies for unified Korean government. The model includes the following major elements: a political culture that appeals to existing understandings of Confucianism and liberal democracy; the return of sovereignty over national security to the unified Korean government and her military forces, preceded by a major powers agreement to guarantee the security of Korea; the organization of an economic development plan for the Northern region; major powers’ most favored nation trade status in exchange for substantial funding of relief, recovery, and reform measures in the Northern region. A national social welfare system, transition from state ownership of property in the North and further reform of economic conglomerates in the South are other related policies. Representation for constituting the national government would occur through an equal number of provinces in newly organized northern and southern regions. Existing executive structures would be reorganized extensively, including the abolishment of current rival state executives. Regional governments would elect governors and legislatures, but there would be a new nationally-elected chief executive and legislature with term limits for the executive. The model also includes the organization of legislative, judicial, and local autonomy aspects of government.
