국문 초록

건강장애 학생은 인간, 아동, 학생, 환자, 특수교육대상학생 그리고 각 개인으로서 복잡하고 중층적인 정체성과 요구를 지닌다. 이 연구는 건강장애의 개념을 이론적으로 분석하고, 건강장애 학생의 인구집단의 통계를 분석하여 다른 장애유형과 구분되는 건강장애의 특수성을 도출하였다. 이 특수성을 바탕으로 건강장애 학생의 학습권의 개념을 재구성하였다. 건강장애의 특수성은 건강장애 개념의 주요 요소인 ‘질환’과 ‘치료 일정’에서 기인한다. 건강장애는 다른 장애유형에 비해 완치, 조기 사망, 특수교육대상 선정 취소 등에 따른 ‘유동성’이 높다. 또한 건강장애 학생은 양적으로 소수일뿐만 아니라, 질환 내적·외적 요인으로 인해 일반교육과 특수교육 분야 모두에서 ‘비가시적’인 ‘이중 마이너리티’이다. 이러한 특수성을 바탕으로 재구성한 건강장애 학생의 학습권 개념과 특성은 다음과 같다. 첫째, 생명권은 건강장애 학생의 학습권의 주요 구성요소이다. 둘째, 통합교육의 관점에서 가시화는 건강장애 학생의 학습권 보장의 선결 조건이다. 셋째, 건강장애의 유동성에 따른 느슨한 연대는 능동적 권리 청구를 어렵게 한다. 따라서 건강장애 학생의 학습권을 보장하기 위해서는 이들의 특수성을 고려하고, 생명권과 가시화를 강조할 필요가 있다.

영문 초록

Students with health impairments have multi-layered Identity. These students possess the rights and demands of being a human, a child, a student, a patient, a person eligible for special education, and an individual. This study theoretically analyzes the concept of health impairments and derives the speciality of health impairments distinct from other disability types by analyzing statistical data related to the population of students with health impairments. Based on this speciality, the concept of the right to learn for students with health impairments is redefined. The speciality of health impairments stems from the key elements of the health impairment concept, namely 'illness' and 'treatment schedule.' recovery, early mortality, and cancellation of special education eligibility can lead to health impairments exhibiting higher 'fluidity' compared to other disability types. Furthermore, students with health impairments are a 'dual minority' due to the intrinsic and extrinsic factors related to their health conditions, making them 'invisibly' marginalized in both mainstream and special education domains. Based on these characteristics, the redefined concept of the right to education for students with health impairments includes the following aspects: Firstly, the right to life constitutes a fundamental component of students with health impairments' right to education. Secondly, visibility, from an inclusion perspective, serves as a prerequisite for ensuring the right to learn for students with health impairments. Lastly, the loose solidarity resulting from the fluidity of health impairments can hinder proactive advocacy for rights. In conclusion, it is crucial to consider the speciality of students with health impairments and emphasize their right to life and visibility to ensure their right to learn.
