법원보안관리대원의 보안성과 고양에 관한 연구

국문 초록

최근 법관 또는 법원 직원을 대상으로 선고 결과에 대한 보복성 폭력행위를 시도하는 경우가 발생하는 등 법원 및 관련 기관의 보안성 강화에 대한 필요성이 높아지고 있다. 이와 관련하여 법원의 보안 전반을 담당하는 법원보안관리대원의 보안성과는 법원의 안전한 환경을 조성하고 나아가 국민의 권리 보호와 직결되어 있다. 이에 이 연구는 법원보안관리대원의 보안성과 고양을 위한 기초자료와 정책적 시사점을 제시하는 것에 그 목적을 두며, 선행연구를 바탕으로 임파워먼트와 조직몰입을 중점적으로 연구를 진행하였다. 2023년 9월 4일부터 2023년 9월 18일까지 서울·부산·대전고등법원 관내에서 근무하는 법원보안관리대원을 대상으로 물리적 안전성 및 인적 보안에 대한 실질적인 보안성과를 측정하고 인과관계를 규명하기 위한 분석을 진행한 결과는 다음과 같다. 먼저 임파워먼트는 조직몰입에 유의한 영향력을 가진 요인으로 확인되었으며 조직몰입 역시 보안성과에 유의한 영향력을 가졌다. 다만, 임파워먼트는 직접적으로 보안성과에 영향을 주진 않았으나 조직몰입을 매개하여 인과관계를 가지고 있다는 것을 확인할 수 있었다. 즉 법원보안관리대원의 보안성과에 있어 임파워먼트와 조직몰입은 중요한 변인임을 확인하였으며, 연구결과를 바탕으로 법원보안관리대 운영에 관한 예규를 개정, 법원보안관리대원이 감치집행 업무수행 시 수갑·포승에 관한 권한, 법원조직법의 개정 등 향후 법원보안관리 시스템 체계화를 위한 정책적 방향성을 제안하였다.

영문 초록

Recently, there have been increased needs to strengthen the security of courts and relevant agencies, due to the such cases of attempting retaliatory violent acts against judges or court employees for the sentencing results. The security performance of court security officers in charge of overall court security is directly related to the managing a safe environment for the court and further protecting the rights of people. Therefore, the purpose of this study is to present basic data and policy implications for enhancing the security performance of court security officers focusing on empowerment and organizational commitment based on the previous studies. From September 4, 2023 to September 18, 2023, the results of an analysis to measure the actual security performance of physical safety and human security and to identify causal relationships for court security officers working in the Seoul, Busan, and Daejeon High Court are as follows. First, empowerment was identified as a factor that had a significant influence on organizational commitment, and organizational commitment also had a significant influence on security performance. However, empowerment did not directly affect security performance, but it was confirmed that it had a causal relationship through organizational commitment. That is, the empowerment and organizational commitment are important variables in the security performance of court security officers. Based on the research results, we proposed a policy direction for systematizing the court security management system in he future such as revision of the established rules on managerial regulations of court security management team, authority to handcuff and capture during the detention execution tasks, and revision of Court Organization Act.
