국문 초록

본 연구의 목적은 위기상황과 재난환경에서 위기가구 지원을 위한 복지전달체계에서 긴급복지지원과 위기개입을 위한 이론과 법적 실천의 통합적 방안을 모색하는데 있다. 이에 긴급복지지원법상 서비스의 즉시성과 접근성이 강조되는 사회복지전달체계의 구축과 통합사례관리, 위기개입 등의 통합적 개입 역량 강화를 위한 사회복지법제와 실천 교육의 방향성을 제언하고자 한다. 첫째, 위기가구 지원에 관여하는 공공과 민간 영역에서 준용해야 할 위기상황의 정의, 재난과 재해, 신사회적 위험에 관련된 법적 정의, 지원대상, 지원범위 및 위기개입 등 사회복지법제와 이론의 통합적 개입 지침이 마련되어야 한다. 둘째, 위기상황에 처한 지원대상자에 대한 긴급복지지원과 맞춤형 서비스 제공을 위하여는 특별법의 우선 적용이 필요하다. 동일한 지원을 받으면 긴급복지지원법상의 지원을 실시하지 않는 원칙과 여러번 새로이 발생될 수 있는 위기와 재난 상황에 관련된 지원 제도의 범위를 통찰하여 사후관리가 가능한 사회복지전달체계 모형을 구축해야 한다. 셋째, 재난취약계층, 안전취약계층, 재난약자 등에 대한 지원을 위하여 사회복지법제와 실천 교육 과정에서는 재난으로 인하여 위기상황에 처한 가구에 대한 이해가 선행되어야 하고, 복지기관 운영상의 재난 예방과 사후대처를 위한 위험관리·위기관리· 안전관리의 통합교육 방법이 실시되어야 한다. 넷째, 위기가구 지원을 위한 사회복지법제와 실천의 통합적 교육 방안으로 사회보장기본법에 의한 맞춤형 급여, 사회보장급여법에 의한 통합사례관리, 긴급복지지원법에 의한 긴급지원, 위기개입 실천과 사후관리의 절차가 포함되어야 한다. 아울러 위기 가구 지원을 위한 사회복지전달체계의 구축은 즉시성·통합성·전문성의 원칙을 강조하여 새로운 위기의 발생에 따라 지역사회 통합돌봄과 통합사례관리 영역의 다학제적 케어 전략으로 대응할 수 있는 순환적 협업이 가능해야 한다. 다섯째, 긴급복지지원의 원칙은 실제 사는 곳에서 지원함이 원칙이므로 사회보장급여법의 일부 개정으로 주민등록 주소지와 달라도 현재의 거소에서 복지급여를 신청할 수 있도록 하는 노력하는 바와 같이, 위기가구의 통합돌봄과 통합사례관리 개입을 위한 보건소, 복지기관, 공공병원 및 사회서비스 광역 연계·제공을 위한 특례 신설이 촉구된다. 여섯째, 위기상황과 위기가구에 처한 위기가구는 생계, 의료, 심리적 회복과 복구 등을 포괄하는 범 거버넌스적 영역으로 사회보장급여법, 긴급복지지원법, 감염병의 예방 및 관리에 관한 법률, 재난안전법, 재해구호법, 자살예방법, 가정폭력방지법, 성폭력방지법 등을 적용한 법적 실천과 위기개입 실천에 의한 사회복지법제와 실천의 통합적 교육 모델을 제안한다.

영문 초록

The purpose of this study is to develop an educational model that integrates social welfare laws with the practice of social welfare. To this end, this researcher sought an educational method to integrate heoretical and legal practice to provide emergency aid and intervene with crisis in the welfare delivery system for supporting households in crisis. Here, this study is going to propose an integrated education method for social welfare legislation and practice grounded on the service delivery system to support households in crisis including the emergency aid and support system, Integrated Care Management, or crisis intervention. First, in the public and private sectors involved in supporting families in crisis, it needs guidelines for integrated intervention of social welfare laws and theories, such as the definition of crisis situations, disasters and disasters, legal definitions related to new social risks, support targets, support scope, and crisis intervention. Second, in order to provide those needing support in crisis with appropriate emergency aid and customized services, it needs to apply special laws first to be necessary. Also, when receiving the same support, it is necessary to build a social welfare delivery system model that enables follow-up management by insight into the principle of not providing support under the 「Emergency Welf are Support Act」 and the range of support systems related to crises and disasters that can occur several times. Third, concerning clear concepts like a disaster vulnerable group, safety vulnerable group, or disaster vulnerable group, education for social welfare legislation and practice should dealt with detailed legal concepts about households in crisis for disasters. Also, in terms of social welfare administration and welfare management, integrated education should be provided to perform danger management, crisis management, and safety management all for prevention and follow-up measures. Fourth, as a method of integrated education for social welfare legislation and practice to support households in crisis, it should include customized benefits under the 「Framework Act on Social Security」, 「Integrated Care Management under the Social Security Benefits Act」, and emergency aid, the practice of crisis intervention, and follow-up management under the 「Emergency Aid and Support Act」. In addition, when establishing a service delivery system to support households in crisis, it should emphasize the principles of comprehensiveness, integration, and expertise so that circular cooperation can be realized between integrated community care and professionals for Integrated Care Management to cope with new crises. Fifth, since emergency aid and support for households in crisis follows the principle of supporting those who actually live in the region, it is necessary to revise the 「Social Security Benefits Act」 or establish special regulations to allow them to apply for customized benefits where they actually live (Si/Gun/Gu/Eup/Myeon) even if the address on the resident registration card is different from where they actually live. Sixth, as households in crisis are the area needing pan-governance protection involving livelihood, medicine, and psychological recovery and restoration, this study suggests an educational model that integrates social welfare legislation and practice to realize legal practice applying the 「Social Security Benefits Act, Emergency Aid and Support Act」, 「Infectious Disease Prevention and Control Act」, 「Disaster Safety Act」, 「Disaster Relief Act」, 「Suicide Prevention Act」, 「Domestic Violence Prevention Act」 or 「Sexual Violence Prevention Act」 and also practice crisis intervention.
