국문 초록

이 연구는 초·중등교육법 연구 성과와 향후 과제를 논의하는 데 주된 목적을 두고 있다. 이를 위해 초·중등교육법 제정과 관련하여 의미가 있는 사건인 1995년 5.31 교육개혁 이후부터 2016년 8월까지 주요 교육법 학술지 117편을 분석하였다. 주요 연구 결과를 제시하면 다음과 같다. 첫째, 초·중등교육법과 관련된 연구 주제로는 학교교육을 둘러싼 인적구성원의 법적지위, 권리·의무관계와 관련된 연구주제가 전체 117편의 연구 가운데 62편(53.0%)으로 나타나 가장 높은 관심이 있는 연구주제로 파악되었다. 둘째, 초·중등교육법 연구와 관련된 연구자들의 분포를 살펴보면 대학에 소속된 교원의 경우 전체 117편의 연구 가운데 81편(69.2%)으로 가장 높은 것으로 나타났다. 셋째, 지난 20년 동안 초·중등교육법 연구는 꾸준히 증가해 오고 있으며, 3년을 주기로 한 분석결과 당대 초·중등교육 분야와 관련된 사회적 이슈를 중심으로 교육법 연구주제가 선정되는 경향이 있는 것으로 파악되었다. 이상의 연구결과를 토대로 초·중등교육법 연구의 향후 과제로 초·중등교육법 연구의 필요성, 학교교육 내용 연구의 확대, 다양한 연구방법론을 활용한 연구 수행, 초·중등교육법 교육의 필요성 등을 제시하였다.

영문 초록

The main purpose of this study is to discuss the achievements of the ‘elementary and secondary education act’ and future tasks in Korea. For this purpose, the 117 major educational law journals were analyzed from the time of the educational reform of 5.31 in 1995 to August, 2016. Major results of this study are as follows. First, 62 subjects (53.0%) of the 117 research subjects related to the legal status, rights and obligations of the members around the school were included in the research topics related to the ‘elementary and secondary education act’ in Korea. Second, the distribution of the researchers related to ‘elementary and secondary education act’ research showed that the professor who belonged to the university had 80(68.3%) among the 117 researches. Third, the researches of elementary and secondary education act have been increasing steadily over the past 20 years. As a result of three - year analysis, it has been found that the subject of educational law research is selected mainly on the social issues related to the current filed of elementary and secondary education.
