요양·돌봄 효율화를 위한 데이터 신탁제도의 도입과 과제

국문 초록

고령화 현상에 따라 의료비용은 증가하고 요양․돌봄 서비스 분야에서 인력난이 심화되고 있다. 그런데 이 문제의 해결책이 될 수 있는 것 중 하나가 인공지능․개인 데이터를 활용한 요양․돌봄 서비스이다. 제론테크(Gerontech)로 대표되는 이러한 기술들은 상당한 진전을 이뤄 많은 요양시설에서 이것을 활용하는 방안을 모색 중이다. 각 요양시설들이 외부 첨단 소프트웨어 회사와 제휴하여 카메라, 온도 감지 센서, IoT, 침대․욕실 등에의 움직임 감지 센서 등을 통해 사고를 방지하고 업무의 효율화를 도모하고 있다. 인공지능 기술에 의한 요양․돌봄을 실현함에 있어서는 그 전제로서 풍부한 데이터의 수집 및 활용이 필수적이다. 그런데 문제는 이러한 기술에 의해 수집하는 데이터가 노인들의 민감정보에 해당하므로 개인정보 보호법상 이것을 이용하는 데에는 엄격한 제한이 따른다는 점이다. 개인 데이터를 가명처리를 하여 활용할 수 있는 방법도 있지만, 요양․돌봄에서는 이것이 오히려 위험을 가져올 수 있다. 만약 동일한 연령과 동일한 신체적 조건을 가진 사람으로 가명처리를 하였는데, 이것이 반드시 다른 사람에게 그대로 맞을 수는 없어 요양․돌봄에서는 오히려 특정 개인을 알아볼 수 있도록 할 필요가 있다. 이러한 개인정보 활용의 문제점을 극복하기 위하여 최근 데이터 신탁을 모색하는 방안이 해외에서는 활발하게 논의되고 있다. 특히 고령자들이 일일이 요양시설에서 개인 데이터가 어떻게 활용되는지 알 수 없는 점을 감안할 때, 신탁에 의해 전문적인 기관이 관리를 함으로써 개인 데이터를 적절히 활용할 뿐만 아니라 개인정보를 보호하는 역할도 담당할 수 있다. 다만 데이터 신탁이 다른 활용 방안보다 유용함에도 불구하고 여전히 신탁법의 구조상 많은 장벽에 부딪힌다. 특히 그 주된 이유 중 하나는 데이터가 재산이 아니므로 신탁재산이 될 수 없고, 수탁자가 이익을 향유할 수 없기 때문에 신탁의 구조와 맞지 않는다는 점이다. 이 연구에서는 최근 해외에서의 논의를 참조하면서 이러한 법적인 문제점을 극복하고 신탁제도를 활용할 수 있는 방안을 모색해 보았다.

영문 초록

With the aging population, medical costs are increasing and nursing and care services are facing shortage of workers. One way to solve this problem is utilizing nursing and care services which uses AI and personal data. Such services, represented by Gerontech, have made remarkable progress and a large number of nursing facilities are seeking for ways to conjugate them. Each nursing facility is partnering with an external high-tech software company in order to prevent accidents and promote efficiency of work through cameras, temperature sensors, IoT, and movement sensors in beds and bathrooms. To realize nursing services done by AI, it is essential to collect and utilize abundant data as a premise. The problem is, these data collected by AI are sensitive information for the elderly, which brings strict restrictions to use them under the Personal Information Protection Act. This can be solved by guaranteeing anonymity to personal data and using them; however, it can rather bring risks to nursing facilities. There are consequences of having two people in same age and same physical conditions, who might be treated in inappropriate prescription because of pseudonymization. In order to solve these problems of utilizing personal information, measures to seek data trusts have recently been actively discussed overseas. In particular, given that the elderly do not have precise information about how personal data are used in nursing facilities, professional institutions can manage personal information by trust to not only properly utilize personal data but also protect personal information. However, despite the fact that data trusts are more useful than other utilization measures, they still face many barriers due to the structure of the Trust Act. One of the main reasons is that data cannot become trust properties because it does not correspond to a property, and that it does not fit the structure of the trust because the trustee cannot possess profits. Referring to the discussions abroad, this study investigated ways to overcome these legal problems and utilize trust system.
