지방체육회 재정 안정화를 위한 법제도 연구

국문 초록

스포츠가 가지는 사회적 가치의 확장으로 지역 스포츠의 진흥을 위해 설립된 지방체육회 역할의 중요성이 강조되고 있다. 「국민체육진흥법」은 지방체육회의 장의 겸임을 금지하면서 민선 회장을 선출하도록 하고, 법정 법인화하였으며, 지방자치단체가 지방체육회의 운영비를 지원하도록 개정되었다. 이처럼 지방체육회의 실질적인 독립을 위하여 관련 법률이 개정되었음에도 국비 및 시비 보조금에 대한 의존율이 높고, 비영리법인이라는 지방체육회의 특성으로 재정에 대한 자립이 이루어지지 않고 있어, 법률 개정의 목적을 무색하게 만들고 있다. 이에 이 글에서는 지방체육회의 재정 안정화 방안을 제시하고 이를 통해 지방체육회를 안정적으로 운영하고 종국에는 독립성을 강화하고자 한다. 지방체육회에 관해 규정하고 있는 「국민체육진흥법」과 일정한 단체의 기부금품의 모집에 관해 규정하고 있는 「기부금품 모집 및 사용에 관한 법률」의 분석을 통해 지방체육회가 자체 재원을 증대하고, 이를 기반으로 재정 자립도를 높일 수 있는 방안을 연구하였다. 지방체육회가 재정 안정화 속에서 지역 스포츠의 발전이라는 스스로의 목적에 충실할 수 있는 방안으로 「국민체육진흥법」에 지방체육회가 수익사업을 할 수 있도록 관련 규정의 개정안을 제시하였고, 지방체육회 임직원의 횡령·배임 등 스포츠비리로 인해 발생하는 재정 악화 상황을 사전에 방지하고자 지방체육회 임직원을 대상으로 하는 스포츠비리 예방 교육의 실시에 관한 규정의 개정안을 제시하였다. 또한 지방체육회가 업무에 대한 역량을 강화하고 전문성을 강화하는 것을 내용으로 하는 교육에 대한 개정안을 제시하였다. 마지막으로 지방체육회의 재정 자립도 강화를 위하여 기부금을 모집할 수 있는 주체로 인정받을 수 있도록 「기부금품 모집 및 사용에 관한 법률」에 대한 개정안을 제시하였다.

영문 초록

The importance of the role of the local sports association established to promote local sports is being emphasized by the expansion of the social value of sports. The National Sports Promotion Act prohibited the concurrent presidency of the local sports association, required the election of a elected president, became a legal corporation, and was revised to support local governments' operating expenses. Despite the revision of the relevant laws for the actual independence of the local sports association, the dependence on state and municipal subsidies is high, and the local sports association, which is a non-profit corporation, does not provide independence for finances, overshadowing the purpose of the law revision. Accordingly, this article proposes a plan to stabilize the finances of the local sports associations, thereby stably operating the local sports associations and eventually strengthening their independence. Through the analysis of the National Sports Promotion Act, which stipulates local sports associations, and the Donation Recruitment and Use Act, which stipulates the recruitment of donations from certain organizations, local sports associations increased their own resources and financial independence based on this basis. A plan for the local sports association to be faithful to its own purpose of developing local sports in the midst of financial stabilization is In the National Sports Promotion Act, a revision to the relevant regulations was proposed to enable local sports associations to conduct profitable businesses, In order to prevent financial deterioration caused by sports corruption, such as embezzlement and breach of trust, a revision to the regulations on the implementation of sports corruption prevention education for executives and employees of local sports associations was proposed. In addition, a revision to education was proposed, which aims to strengthen the competence and expertise of local sports associations in their work. Finally, in order to strengthen the financial independence of the local sports associations, an amendment to the Act on the Recruitment and Use of Donations was proposed so that they could be recognized as the subject of collecting donations.
