장애인차별금지 실효성 강화를 위한 입법 방향

국문 초록

이 연구는 장애인차별금지법 개정과 포괄적 차별금지법 제정 논의가 혼재하는 상황에서 더 실효성 있는 법으로의 입법방향을 제시하고자 하였다. 이를 위해 보편적인 인권법을 제정한 후에 세계 최초로 장애인차별금지법을 제정한 미국의 미국장애인법과, 장애차별금지법을 먼저 제정한 이후 포괄적 차별금지법인 평등법으로 통합한 영국평등법, 현재 발의 중인 포괄적 차별금지법안, 현행법인 장애인차별금지법을 비교 분석하였다. 분석 결과, 장애 사유를 포함한 포괄적 차별금지법을 만들 경우, 차별의 대상이 되는 장애의 범위 축소, 장애로 인한 차별 유형의 축소, 차별영역의 축소 현상이 나타날 수 있음이 밝혀졌다. 또 차별금지 예외 규정은 포괄적 차별금지법으로 제정하는 것이 장애인차별금지법으로 제정할 때보다 유리하다. 이에 따라 포괄적 차별금지법을 제정할 경우, 장애 범위를 현재 장애뿐만 아니라 과거 장애, 간주 장애, 연계 장애까지도 포함할 필요가 있고, 장애로 인한 차별, 합리적 조정의무의 거부 등과 같은 장애 특이적 차별 유형을 추가하여야 하고, 차별금지 영역을 민간제공 서비스 및 사적 영역까지 포괄할 필요가 있다. 장애인차별금지법을 개정하여 강화할 경우, 차별금지 예외 규정의 축소, 징벌적 손해배상 도입 등 처벌 강화, 전환적 평등 추구 등이 추가될 필요가 있다.

영문 초록

This study aimed to suggest a legislative direction for a more effective law in a situation where the revision of the Anti-Discrimination Act for persons with disability and the enactment of the Comprehensive Anti-Discrimination Act are mixed. To this end, the US Americans with Disability Act, UK Equality Act, The current Anti-Discrimination Act for persons with disability, Comprehensive anti-discrimination bill currently being proposed to the National Assembly were compared and analyzed. As a result, it was revealed that if a comprehensive anti-discrimination law is enacted, the range of disabilities subject to discrimination, the type of discrimination due to disability, and the scope of discrimination may be reduced. In addition, from the point of view of discrimination exception, enacting the Comprehensive Anti-Discrimination Act is more advantageous. Accordingly, when enacting the Comprehensive Anti-Discrimination Act, the scope of disability needs to include not only current disabilities, but also past disabilities, perceived disabilities, and related disabilities, and disability-specific discrimination types such as discrimination based on disabilities and refusal of the duty of reasonable accommodation must be addressed. If the Anti-Discrimination Act is amended and strengthened, it is necessary to add reduction of exceptions to anti-discrimination, strengthen punishment such as introduction of punitive damages, and pursuit of transformative equality.
