장애인 비하용어를 둘러싼 무질서와 딜레마

국문 초록

이 연구에서는 장애인 비하용어를 둘러싼 문제점을 무질서와 딜레마라는 관점에서 분석하고 이를 해소하기 위해서는 어떤 고민들이 수반되어야 하는지를 살펴보고자 한다. 먼저 3가지 기준을 따라 장애인 비하용어를 다루는 여러 기관 중에서 3개 기관을 선정하여 이들이 선정한 비하용어를 둘러싼 문제점들을 분석하였다. 이를 통해 그동안 장애인 비하용어에 대한 다양한 연구가 있었고 아울러 대안용어를 사용하려는 노력이 있었음에도 불구하고 선정된 용어의 기관간 불일치, 선정한 비하용어와 실제 법령 및 일상생활 사용 간의 결절 등 무질서한 모습이 발견된다. 아울러 그동안 관행적으로 사용해 오는 용어에 대한 접근·이해 관점의 부재, 비하용어와 특정 상황과 맥락을 내포하는 비하표현이 어떻게 차별행위로 이어지는지를 판단할 수 있는 기준이 없다는 점에서 비하용어를 선정하더라도 사회적 대응 및 법적 처벌로 연결하기 어려운 딜레마를 안고 있다. 이러한 문제와 한계를 극복하기 위해서는 장애인차별금지법의 소관부처인 보건복지부와 집행기관인 국가인권위원회가 비하용어의 범위와 종류를 국가적 차원에서 결정하고 비하용어 표현이 차별행위로 간주될 수 있는 상황과 맥락에 대한 판단 기준 및 관점을 정립하고 장애인차별금지법 제32조(괴롭힘 등)의 판단기준으로 연결시키는 방안을 모색할 필요가 있다.

영문 초록

The main purpose of this research is to critically analyze problems with the perspective of chaos and dilemma and to review what should be designed and elaborated against such problems. To do this 3 institutions applying 3 criteria as boundary of this research were selected among several institutions dealing with derogatory terms in relation to disabled people. Though there were some previous related research and efforts to make alternative terms use instead of deragotory terms, there found chaos of different boundary of derogatory terms among 3 institutions and also split between derogatory terms and actual use in laws and daily life. In addition absence of perspective in approaching and understanding of linking context between derogatory terms and context surrounding the circumstance that such terms were expressed. These chaos and dilemma play a key role of making derogatory terms underpinn as legal criteria. To solve these problems Ministry of Health and Welfare governing Disability Discrimination Act and National Human Right Committee in charge of executing the Act work together and elaborate the boundary of derogatory terms and judgement criteria between the terms and their expression which consider circumstance and context. And finally the terms and criteria should be linked with article 32 of Disability Discrimination Act to make it actually work.
